SYNOPSIS AS INTRODUCED:

605 ILCS 140/90 rep.

    Amends the Expressway Camera Act. In addition to offenses involving the use of a firearm, adds carjacking and other violent crimes as offenses that a law enforcement agency may investigate using images from an expressway camera. Provides that nothing in the Act shall prohibit the Illinois State Police from using images from an expressway camera to investigate any offense involving a violent crime. Removes the Act repeal date of July 1, 2023.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Expressway Camera Act is amended by
5changing Section 5 as follows:
 
6    (605 ILCS 140/5)
7    (Section scheduled to be repealed on July 1, 2023)
8    Sec. 5. Camera program.
9    (a) The Illinois State Police, the Illinois Department of
10Transportation, and the Illinois State Toll Highway Authority
11shall work together to conduct a program to increase the
12amount of cameras along expressways in Cook County.
13    (b) Images from the cameras may be used by any municipal
14police department, county sheriff's office, State Police
15officer, or other law enforcement agency with jurisdiction
16over the expressway in Cook County in the investigation of any
17offense involving carjacking, the use of a firearm, or other
18violent crime and to detect expressway hazards. Images from
19the cameras shall not be used to enforce petty offenses.
20    (b-5) Nothing in this Act shall prohibit the Illinois
21State Police from using images from an expressway camera to
22investigate any offense involving a violent crime.
23    (c) Subject to appropriation, any funds needed to conduct

1the program for use on expressways under the jurisdiction of
2the Department of Transportation shall be taken from the Road
3Fund.
4    (d) As used in this Section, "expressway" has the meaning
5provided in Section 1-119.3 of the Illinois Vehicle Code.
