SYNOPSIS AS INTRODUCED:

    Amends the Legislative Commission Reorganization Act of 1984. Provides that the Architect of the Capitol is authorized and empowered to secure designs for a statue of the Reverend Dr. Martin Luther King Jr., to be erected on the grounds of the State Capitol Complex. Establishes the Illinois State Capitol Statue and Monument Commission to review and advise the Architect of the Capitol on a design for a statue of the Reverend Dr. Martin Luther King Jr. Provides for membership of the Commission. Provides further requirements concerning Commission meetings, compensation, and administrative support. Provides that the Commission shall be dissolved upon the placement of the statue. Provides that the Architect of the Capitol is authorized and empowered to acquire, erect on the grounds of the State Capitol Complex, and maintain the statue of the Reverend Dr. Martin Luther King Jr. from a design based upon the advice provided by the Illinois State Capitol Statue and Monument Commission. Provides for the placement and unveiling of the statue within a reasonable period of time after the effective date of the amendatory Act, but no later than January 1, 2025. Provides funding for the payment of expenses associated with the placement of the statue from the Capitol Restoration Trust Fund. Repeals provisions on January 1, 2026.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Legislative Commission Reorganization Act
5of 1984 is amended by changing Section 8A-35 and by adding
6Section 8A-60 as follows:
 
7    (25 ILCS 130/8A-35)
8    Sec. 8A-35. Capitol Restoration Trust Fund;
9appropriations.
10    (a) The Capitol Restoration Trust Fund is created as a
11special fund within the State treasury. The Fund may accept
12deposits from any source, whether private or public, and may
13be appropriated only for the use of the Architect of the
14Capitol in the performance of his or her powers and duties. The
15Architect of the Capitol may seek private and public funds for
16deposit into the Capitol Restoration Trust Fund.
17    (a-5) The Capitol Restoration Trust Fund shall contain a
18separate account for the deposit of funds donated for the
19payment of expenses associated with the placement of a statue
20on the grounds of the State Capitol Complex depicting the
21Reverend Dr. Martin Luther King Jr., as provided under Section
228A-60. The separate account may accept deposits from any
23source, whether private or public, and may be appropriated for

1use by the Architect of the Capitol for expenses associated
2with the acquisition, placement, and maintenance of the statue
3of the Reverend Dr. Martin Luther King Jr., as authorized
4under Section 8A-60. The Architect of the Capitol may seek
5private and public funds for deposit into the separate account
6of the Capitol Restoration Trust Fund established under this
7subsection (a-5). This subsection (a-5) is inoperative on
8January 1, 2026.
9    (b) The Architect of the Capitol shall submit all budget
10requests to implement the master plan that relate to areas of
11the legislative complex other than the State Capitol Building
12to the Capitol Historic Preservation Board for review and
13comment. The Architect of the Capitol shall submit all budget
14requests to the Board of the Office of the Architect of the
15Capitol for approval.

18    Sec. 8A-60. State Capitol historical monuments.
19    (a) The Architect of the Capitol is authorized and
20empowered to secure designs for a statue of the Reverend Dr.
21Martin Luther King Jr., to be erected on the grounds of the
22State Capitol Complex.
23    (b) There is hereby established the Illinois State Capitol
24Statue and Monument Commission to review and advise the
25Architect of the Capitol on a design for a statue of the

1Reverend Dr. Martin Luther King Jr. The Commission shall
2consist of the following members:
3        (1) the Governor or his or her designee;
4        (2) the Secretary of State or his or her designee;
5        (3) the President of the Senate or his or her
6    designee;
7        (4) the Minority Leader of the Senate or his or her
8    designee;
9        (5) the Speaker of the House of Representatives or his
10    or her designee;
11        (6) the Minority Leader of the House of
12    Representatives or his or her designee; and
13        (7) the Architect of the Capitol or his or her
14    designee.
15    (c) The Commission shall hold its first meeting as soon as
16practicable after the effective date of this amendatory Act of
17the 102nd General Assembly, and shall hold as many meetings as
18deemed necessary for its purposes under this Section. Members
19of the Commission shall serve without compensation. The Office
20of the Architect of the Capitol shall provide administrative
21support to the Commission. Any member of the Commission who
22leaves office before the work of the Commission is completed
23shall be permitted to remain on the Commission after leaving
24office if that member held his or her prior office for at least
2520 consecutive years. The Commission shall be dissolved upon
26the placement of the statue of the Reverend Dr. Martin Luther

1King Jr. as provided under this Section.
2    (d) The Architect of the Capitol is authorized and
3empowered to acquire, erect on the grounds of the State
4Capitol Complex, and maintain a statue of the Reverend Dr.
5Martin Luther King Jr. from a design based upon the advice
6provided by the Illinois State Capitol Statue and Monument
7Commission.
8    (e) The Architect of the Capitol shall take actions
9necessary to provide for the placement and unveiling of the
10statue authorized under this Section within a reasonable
11period of time after the effective date of this amendatory Act
12of the 102nd General Assembly, but no later than January 1,
132025.
14    (e) This Section is repealed on January 1, 2026.
