SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/19.11

    Amends the Environmental Protection Act. In a Section concerning notice of public water supply disruption, provides that the definition of "disruption event" includes any change to a disinfection technique, practice, or technology, including each instance of any change in the concentration of any disinfectant in the water of a public water supply that results in residual concentrations of the disinfectant in the water either rising above 150% or falling below 80% (instead of "exceeding 50% or falling below 20%") of the monthly average concentration of disinfectant reported to the Environmental Protection Agency in a public water distribution entity's most recent monthly submission of Daily Operating Reports. Effective immediately or on the date House Bill 4988 of the 102nd General Assembly takes effect, whichever is later.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. If and only if House Bill 4988 of the 102nd
5General Assembly becomes law, the Environmental Protection Act
6is amended by changing Section 19.11 as follows:
 
7    (415 ILCS 5/19.11)
8    Sec. 19.11. Public water supply disruption; notification.
9    (a) In this Section:
10    "Disruption event" means any:
11        (1) change to a disinfection technique, practice, or
12    technology, including each instance of any change in the
13    concentration of any disinfectant in the water of a public
14    water supply that results in residual concentrations of
15    the disinfectant in the water either rising above 150% or
16    falling below 80% exceeding 50% or falling below 20% of
17    the monthly average concentration of disinfectant reported
18    to the Agency in a public water distribution entity's most
19    recent monthly submission of Daily Operating Reports;
20        (2) planned or unplanned work on or damage to a water
21    main;
22        (3) change in a treatment application or source of
23    water that results in an altered finished water quality;

1        (4) event that results in a public water supply's
2    operating pressure falling below 20 PSI; or
3        (5) condition that results in the issuance of a boil
4    water order.
5    "Health care facility" means a facility, hospital, or
6establishment licensed or organized under the Ambulatory
7Surgical Treatment Center Act, the University of Illinois
8Hospital Act, the Hospital Licensing Act, the Nursing Home
9Care Act, the Assisted Living and Shared Housing Act, or the
10Community Living Facilities Licensing Act.
11    "Health care facility list" means a list enumerating
12health care facilities and their designees that are served by
13a public water supply and maintained by a public water
14distribution entity.
15    "Public water distribution entity" means any of the
16following entities that are responsible for the direct
17supervision of a public water supply: a municipality, a
18private corporation, an individual private owner, or a
19regularly organized body governed by a constitution and
20by-laws requiring regular election of officers.
21    "Public water supply" has the same meaning as defined in
22Section 3.365.
23    "State agencies" means the Illinois Environmental
24Protection Agency and the Illinois Department of Public
25Health.
26    "Water supply operator" means any individual trained in

1the treatment or distribution of water who has practical,
2working knowledge of the chemical, biological, and physical
3sciences essential to the practical mechanics of water
4treatment or distribution and who is capable of conducting and
5maintaining the water treatment or distribution processes of a
6public water supply in a manner that will provide safe,
7potable water for human consumption.
8    (b) A public water distribution entity, through its
9designated employees or contractors, shall notify its water
10supply operator and all affected health care facilities on the
11public water supply's health care facility list not less than
1214 days before any known, planned, or anticipated disruption
13event. An anticipated disruption event includes for purposes
14of this subsection any disruption event that could or should
15be reasonably anticipated by a public water distribution
16entity.
17    (c) A public water distribution entity, through its
18designated employees or contractors, shall notify its water
19supply operator and all affected health care facilities that
20are served by the public water supply and affected by any
21unplanned disruption event in the public water supply's water
22distribution system. The notification required under this
23subsection shall be provided within 2 hours after the public
24water distribution entity becomes aware of the unplanned
25disruption event.
26    (d) A health care facility shall designate an email

1address to receive electronic notifications from the public
2water distribution entity concerning planned or unplanned
3disruption events. The email account shall be accessible to
4the health care facility's designated water management plan
5administrator and other responsible administrative personnel.
6    (e) Any planned or unplanned disruption event notification
7sent to a health care facility under this Section shall also be
8sent to the State agencies via email to the email addresses
9designated by the State agencies within 5 business days. The
10State agencies shall establish, maintain, and retain a list of
11notifications received pursuant to this subsection.
12    The notice required under this Section shall include, but
13shall not be limited to, the following:
14        (1) a detailed description of the disruption event;
15        (2) the date, time, and location of the disruption
16    event;
17        (3) the expected time needed to resolve the disruption
18    event; and
19        (4) a list of the health care facilities notified by
20    the public water distribution entity.
21    Beginning one year after the effective date of this
22amendatory Act of the 102nd General Assembly, the State
23agencies shall make available upon request a list of
24disruption events, in an electronic format, sorted by the year
25and month of each occurrence.

1    Section 99. Effective date. This Act takes effect upon
2becoming law or on the date House Bill 4988 of the 102nd
3General Assembly takes effect, whichever is later.
