HOUSE RESOLUTION

 
2    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
3HUNDRED SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
4the Rules of the House of Representatives of the 102nd General
5Assembly are amended by changing Rules 52 and 59 as follows:
 
 
6    (House Rule 52)
7    52. Debate.
8    (a) All legislative measures, except those legislative
9measures that are not debatable as provided in these Rules,
10are subject to a debate status as follows:
11        (1) Short Debate: Debate is limited to a 2-minute
12    presentation by the Principal Sponsor or a member
13    designated by the Principal Sponsor, a 2-minute
14    presentation by a member in response, and one minute for
15    the Principal Sponsor to close debate, or yield to other
16    members; provided that at the request of 7 members before
17    the close of debate, the debate status shall be opened to
18    standard debate; or
19        (2) Standard Debate: Debate shall consist of a
20    10-minute presentation by the Principal Sponsor or a
21    member designated by the Principal Sponsor, debate by each
22    proponent and member in response who seeks recognition,
23    and 5 minutes for the Principal Sponsor to close debate,

1    or yield to other members. Debate is limited to a 5-minute
2    presentation by the Principal Sponsor or a member
3    designated by the Principal Sponsor, debate by each of 2
4    additional proponents of the legislative measure and by 3
5    members in response to the legislative measure, and 3
6    minutes for the Principal Sponsor to close debate, or
7    yield to other members;
8        (3) Extended Debate: Debate is limited to a 5-minute
9    presentation by the Principal Sponsor or a member
10    designated by the Principal Sponsor, debate by each of 4
11    proponents of the legislative measure and 5 members in
12    response, and 5 minutes for the Principal Sponsor to close
13    debate, or yield to other members;
14        (4) Unlimited Debate: Debate shall consist of a
15    10-minute presentation by the Principal Sponsor or a
16    member designated by the Principal Sponsor, debate by each
17    proponent and member in response who seeks recognition,
18    and 5 minutes for the Principal Sponsor to close debate,
19    or yield to other members; or
20        (5) Amendment Debate: Debate on floor amendments
21    referred to the House from a committee, or discharged from
22    a committee, is limited to a 3-minute presentation by the
23    Principal Sponsor, or a member designated by the Principal
24    Sponsor, debate by one proponent, debate by each of 2
25    members in response, and 3 minutes for the Principal
26    Sponsor to close debate, or yield to other members.

1    No debate is in order on bills or resolutions on the order
2of First Reading or Second Reading, except for debate on floor
3amendments as provided in this Rule.
4    (b) All legislative measures, except those assigned to the
5Consent Calendar or , those assigned short debate status by a
6standing or special committee, and floor amendments, referred
7to the House from a committee, or discharged from a committee,
8are automatically assigned standard debate status, subject to
9subsection (c) of this Rule. A bill, resolution, or joint
10action motion for final action shall be given short debate
11status by report of the committee if the bill or resolution was
12favorably reported by a three-fifths vote of the members
13present and voting, including those voting "present", subject
14to subsection (c) of this Rule. All floor amendments referred
15to the House from a committee, or discharged from a committee,
16are automatically assigned amendment debate status, subject to
17subsection (c) of this Rule.
18    (c) (blank.) Notwithstanding any other provision of these
19Rules to the contrary (except Rule 44), the debate status of
20any legislative measure may be changed only (i) by the
21Speaker, as defined in item (27) of Rule 102, by filing a
22notice with the Clerk, or (ii) by the Rules Committee by motion
23approved by a majority of those appointed. While a legislative
24measure is being considered by the House, the debate status
25may also be changed by unanimous consent. No legislative
26measure, however, may be placed on the Consent Calendar under

1this Rule. No legislative measure, except a floor amendment,
2may be assigned amendment debate status under this Rule.
3    (d) (blank.) The Speaker or Rules Committee, as the case
4may be, shall notify the Clerk of any action to change the
5debate status of any legislative measure. The Clerk shall
6cause that information to be reflected on the Daily Calendar
7on subsequent legislative days, provided the legislative
8measure is still before the House.
9    (e) No member shall speak longer than 5 minutes at one time
10or more than once on the same question except by leave of the
11House. The Principal Sponsor of a measure or a member
12designated by the Principal Sponsor, however, shall be allowed
13to open the debate and to close the debate in accordance with
14subsection (a) of this Rule. The provisions of this subsection
15(e) are subject to and limited by subsections (a)and , (b), and
16(c) of this Rule. A member may yield to another member the time
17allotted for the member's debate.
18    (f) The Presiding Officer shall allocate the debate on
19each legislative measure alternately, if possible, between
20proponents and opponents of the legislative measure under
21debate.
22    (g) This Rule may not be suspended.

25    59. Previous Question.

1    (a) A motion for the previous question may be made at any
2time, except that a member may not move the previous question
3while participating in debate pursuant to Rule 52. A motion
4for the previous question is not debatable and requires the
5unanimous consent of the members present or the affirmative
6vote of two-thirds of the 60 members elected. A record vote
7must be taken on the motion if unanimous consent has been
8denied. This subsection may not be suspended.
9    (b) The previous question shall be stated in the following
10form: "Shall the main question be put?" Until the previous
11question is decided, all amendments and debate are precluded.
12When it is decided that the main question shall not be put, the
13main question remains under debate.
14    (c) The effect of the main question being ordered is to put
15an end to all debate and bring the House to a direct vote on
16the immediately pending motion. After a motion for the
17previous question has been approved, it is not in order to move
18for adjournment or to make any other motion before a decision
19on the main question.
20    (d) This Rule may be suspended only by the affirmative
21vote of 71 members elected.
