| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly:
| 4 | | Section 5. The Water Commission Act of 1985 is amended by | 5 | | changing Section 0.001 as follows: | 6 | | (70 ILCS 3720/0.001) | 7 | | Sec. 0.001. Commissioners; terms; vacancies. Effective | 8 | | January 1, 2011, the terms of office of the chairperson and all | 9 | | commissioners of water commissions appointed pursuant to this | 10 | | Act shall terminate and the commission shall be reconstituted. | 11 | | (a) The commissioners of water commissions appointed | 12 | | pursuant to this Act shall be appointed as follows: | 13 | | (1) A chairperson, who shall also serve in the | 14 | | capacity of a commissioner, shall be appointed by the | 15 | | chairperson of the county board of the home county with | 16 | | the advice and consent of the county board. For | 17 | | appointments made on or after the effective date of this | 18 | | amendatory Act of the 102nd General Assembly, the | 19 | | chairperson shall be a resident of the home county. | 20 | | (2) One commissioner from each county board district | 21 | | within the home county shall be appointed by the | 22 | | chairperson of the county board of the home county with | 23 | | the advice and consent of the county board. |

| 1 | | (3) One commissioner from each county board district | 2 | | within the home county shall be appointed by the majority | 3 | | vote of the mayors of those included municipalities that | 4 | | have the greatest percentage of their respective | 5 | | populations residing within such county board district of | 6 | | the home county. A vice-chairperson of the commission | 7 | | shall be appointed from the commissioners appointed | 8 | | pursuant to this paragraph by a majority vote of these | 9 | | commissioners. | 10 | | (4) Upon receipt of water by any territorial | 11 | | municipality, one commissioner from a territorial | 12 | | municipality shall be appointed by the chairperson of the | 13 | | county board of the home county with the advice and | 14 | | consent of the county board. | 15 | | (5) Upon receipt of water by a territorial | 16 | | municipality, one commissioner from a territorial | 17 | | municipality shall be appointed by the majority vote of | 18 | | the mayors of those territorial municipalities. | 19 | | (b) All commissioners shall be residents of the home | 20 | | county or a resident of an included municipality. However, | 21 | | commissioners appointed under paragraph (4) or (5) of | 22 | | subsection (a) on or after the effective date of this | 23 | | amendatory Act of the 102nd General Assembly shall be | 24 | | residents of a territorial municipality. | 25 | | (c) The initial commissioners appointed pursuant to | 26 | | subsection (a) shall serve the following terms: |

| 1 | | (1) The chairperson shall serve for a term of 6 years. | 2 | | (2) At the first meeting of the commission held after | 3 | | January 1, 2011, the commissioners appointed pursuant to | 4 | | paragraph (2) of subsection (a) shall determine publicly | 5 | | by lot one-third of their members to serve for a term of 2 | 6 | | years, one-third of their members to serve for a term of 4 | 7 | | years, and one-third of their members to serve for a term | 8 | | of 6 years, any odd number of commissioners so determined | 9 | | by dividing into thirds to serve 6-year terms. | 10 | | (3) At the first meeting of the commission held after | 11 | | January 1, 2011, the commissioners and the | 12 | | vice-chairperson appointed pursuant to paragraph (3) of | 13 | | subsection (a) shall determine publicly by lot one-third | 14 | | of their members to serve for a term of 2 years, one-third | 15 | | of their members to serve for a term of 4 years, and | 16 | | one-third of their members to serve for a term of 6 years, | 17 | | any odd number of commissioners so determined by dividing | 18 | | into thirds to serve 6-year terms. | 19 | | (4) The commissioner appointed pursuant to paragraph | 20 | | (4) of subsection (a) shall serve an initial term of 3 | 21 | | years. | 22 | | (5) The commissioner appointed pursuant to paragraph | 23 | | (5) of subsection (a) shall serve an initial term of 6 | 24 | | years. | 25 | | The successor commissioners shall serve for a term of 6 | 26 | | years or until their successors have been appointed and |

| 1 | | qualified in the same manner as the original appointments. | 2 | | (d) A commissioner shall be eligible for reappointment | 3 | | upon the expiration of his or her term. A vacancy in the office | 4 | | of a commissioner shall be filled for the balance of the | 5 | | unexpired term by appointment and with the qualifications as | 6 | | to residency in the same manner as the original appointment | 7 | | was made. | 8 | | (e) A commissioner may be a member of the governing board, | 9 | | an officer, or an employee of the county or any unit of local | 10 | | government located within the county.
| 11 | | (f) As used in this Section, "territorial municipality" | 12 | | means a municipality entirely outside of the home county, but | 13 | | within the territorial limits and receiving water from the | 14 | | water commission. | 15 | | (Source: P.A. 96-1389, eff. 7-29-10.)
| 16 | | Section 99. Effective date. This Act takes effect upon | 17 | | becoming law.
