Amends the Toll Highway Act. Increases the number of directors of the Illinois State Toll Highway Authority appointed by the Governor from 9 to 11. Provides that, of the 11 directors of the Authority appointed by the Governor, at least one shall be from Cook County, at least one shall be from Lake County, at least one shall be from DuPage County, at least one shall be from Will County, at least one shall be from Winnebago, Boone, or McHenry County, and at least one shall be from Kane, DeKalb, Ogle, or Lee County. Provides that no more than 6 (rather than 5) directors shall be from the same political party. Provides that, within 30 days of the effective date of the amendatory Act, the Governor shall appoint one director from Lake County and one director from Winnebago, Boone, or McHenry County. Effective immediately. |

| 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly:
| 4 | | Section 5. The Toll Highway Act is amended by changing | 5 | | Section 3 as follows:
| 6 | | (605 ILCS 10/3) (from Ch. 121, par. 100-3)
| 7 | | Sec. 3.
There is hereby created an Authority to be known as | 8 | | The
Illinois State Toll Highway Authority, which is hereby | 9 | | constituted an
instrumentality and an administrative agency of | 10 | | the State of Illinois.
The said Authority shall consist of 13 | 11 | | 11 directors; the Governor and the
Secretary of the Department | 12 | | of Transportation, ex officio, and 11 9
directors appointed by | 13 | | the Governor with the advice and consent of the
Senate, from | 14 | | the State at large, which said directors and their
successors | 15 | | are hereby authorized to carry out the provisions of this
Act, | 16 | | and to exercise the powers herein conferred. Of the 11 9 | 17 | | directors
appointed by the Governor, at least one director | 18 | | shall be from Cook County, at least one director shall be from | 19 | | Lake County, at least one director shall be from DuPage | 20 | | County, at least one director shall be from Will County, at | 21 | | least one director shall be from Winnebago, Boone, or McHenry | 22 | | County, at least one director shall be from Kane, DeKalb, | 23 | | Ogle, or Lee County, and no more than 6 5 shall be members of |

political party. Within 30 days after the effective | 2 | | date of this amendatory Act of the 102nd General Assembly, the | 3 | | Governor shall appoint one director from Lake County and one | 4 | | director from Winnebago, Boone, or McHenry County. | 5 | | Notwithstanding any provision of law to the contrary, the | 6 | | term of office of each director of the Authority serving on the | 7 | | effective date of this amendatory Act of the 100th General | 8 | | Assembly, other than the Governor and the Secretary of the | 9 | | Department of Transportation, is abolished and a vacancy in | 10 | | each office is created on the effective date of this | 11 | | amendatory Act of the 100th General Assembly. The Governor | 12 | | shall appoint directors to the Authority for the vacancies | 13 | | created under this amendatory Act of the 100th General | 14 | | Assembly by February 28, 2019. Directors whose terms are | 15 | | abolished under this amendatory Act of the 100th General | 16 | | Assembly shall be eligible for reappointment. | 17 | | Vacancies shall be filled for the unexpired term
in the | 18 | | same manner as original appointments. All appointments shall | 19 | | be
in writing and filed with the Secretary of State as a public | 20 | | record. It
is the intention of this section that the | 21 | | Governor's appointments shall
be made with due consideration | 22 | | to the location of proposed toll highway
routes so that | 23 | | maximum geographic representation from the areas served
by | 24 | | said toll highway routes may be accomplished insofar as | 25 | | practicable.
The said Authority shall have the power to | 26 | | contract and be contracted
with, to acquire, hold and convey |

| 1 | | personal and real property or any
interest therein including | 2 | | rights of way, franchises and easements; to
have and use a | 3 | | common seal, and to alter the same at will; to make and
| 4 | | establish resolutions, by-laws, rules, rates and regulations, | 5 | | and to
alter or repeal the same as the Authority shall deem | 6 | | necessary and
expedient for the construction, operation, | 7 | | relocation, regulation and
maintenance of a system of toll | 8 | | highways within and through the State of
Illinois.
| 9 | | Appointment of the additional directors provided for by | 10 | | this amendatory
Act of 1980 shall be made within 30 days after | 11 | | the effective date of this
amendatory Act of 1980.
