SYNOPSIS AS INTRODUCED:

425 ILCS 30/5 new

Amends the Fireworks Regulation Act of Illinois. Provides that the storage, possession, sale, and use of nonfireworks shall be permitted at all times throughout the State. Requires regulation of nonfireworks, including their storage and sale, to be consistent with the standards set forth in the National Fire Protection Association's Code for the Manufacture, Transportation, Storage and Retail Sales of Fireworks and Pyrotechnic Articles, 2006 edition. Provides that the amendatory provisions do not apply to the City of Chicago. Defines "nonfireworks".

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Fireworks Regulation Act of Illinois is amended by adding Section 5 as follows:

(425 ILCS 30/5 new)

Sec. 5. Storage, possession, sale, and use of nonfireworks.

(a) The storage, possession, sale, and use of nonfireworks shall be permitted at all times throughout the State.

(b) The regulation of nonfireworks, including their storage and sale, shall be consistent with the standards set forth in the National Fire Protection Association's Code for the Manufacture, Transportation, Storage and Retail Sales of Fireworks and Pyrotechnic Articles (NFPA 1124), 2006 edition.

(c) Subsections (a) and (b) do not apply to the City of Chicago.

(d) In this Section, "nonfirework" means:

(1) toy pistols that use caps containing fewer than 20/100 grains of explosive mixture;

(2) toy guns that use paper caps containing 25/100 grains or fewer of explosive compound;

(3) wood stick or wire sparklers containing not more than I00 grams of pyrotechnic mixture per item;

(4) handheld or ground based sparkling devices that are nonexplosive and nonaerial, sometimes producing a crackling or whistling effect, and containing 75 grams or fewer of pyrotechnic composition per tube or a total of 500 grams or fewer for multiple tubes;

(5) snakes and glow worms;

(6) smoke devices; and

(7) trick noisemakers, including, but not limited to, party poppers, snappers, and drop pops, each containing 25/100 grains or fewer of explosive mixture.
