SYNOPSIS AS INTRODUCED:

    Amends the State Comptroller Act. Provides that the State Comptroller is authorized during State fiscal years 2022 and 2023 to acquire real property located in the City of Springfield, which the State Comptroller deems necessary to properly carry out the powers and duties vested in him or her. Provides further powers and duties concerning the acquisition of such real property. Creates the Capital Facility and Technology Modernization Fund as a special fund in the State treasury. Provides for the use of moneys in the Fund. Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that, to the extent possible, any relocated State employment positions and offices shall be relocated to the City of Springfield, as the State capitol, and to downtown Springfield specifically. Authorizes the Department of Central Management Services to purchase real property in Springfield for relocation purposes. Amends the State Finance Act to provide for the Capital Facility and Technology Modernization Fund. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Comptroller Act is amended by adding
5Section 28 as follows:
 
6    (15 ILCS 405/28 new)
7    Sec. 28. State Comptroller purchase of real property.
8    (a) Subject to the provisions of the Public Contract Fraud
9Act, the State Comptroller, on behalf of the State of
10Illinois, is authorized during State fiscal years 2022 and
112023 to acquire real property located in the City of
12Springfield, as the State capitol, which the State Comptroller
13deems necessary to properly carry out the powers and duties
14vested in him or her. Real property acquired under this
15Section may be acquired subject to any third party interests
16in the property that do not prevent the State Comptroller from
17exercising the intended beneficial use of such property. This
18subsection (a) is inoperative on and after July 1, 2023.
19    (b) Subject to the provisions of the Comptroller's
20Procurement Rules, which shall be substantially in accordance
21with the requirements of the Illinois Procurement Code, the
22State Comptroller may:
23        (1) enter into contracts relating to construction,

1    reconstruction, or renovation projects for any such
2    buildings or lands acquired under subsection (a); and
3        (2) equip, lease, repair, operate, and maintain those
4    grounds, buildings, and facilities as may be appropriate
5    to carry out his or her statutory purposes and duties.
6    (c) The State Comptroller may enter into agreements for
7the purposes of exercising his or her authority under this
8Section.
9    (d) The exercise of the authority vested in the
10Comptroller to acquire property under this Section is subject
11to appropriation.
12    (e) The Capital Facility and Technology Modernization Fund
13is hereby created as a special fund in the State treasury.
14Subject to appropriation, moneys in the Fund shall be used by
15the Comptroller for the purchase, reconstruction, lease,
16repair, and maintenance of real property as may be acquired
17under this Section, including for expenses related to the
18modernization and maintenance of information technology
19systems and infrastructure.
 
20    Section 10. The Department of Central Management Services
21Law of the Civil Administrative Code of Illinois is amended by
22changing Section 405-413 as follows:

24    Sec. 405-413. Geographic consolidation of State employment

1positions.
2    (a) Notwithstanding any other law to the contrary, the
3Director of Central Management Services, working in
4consultation with the Director of any affected State agency,
5shall direct the relocation to Sangamon County of all State
6employment positions under the Personnel Code that are not
7required by their nature or function to be located in a
8specific geographic area.
9    (b) Notwithstanding any other law to the contrary, the
10Director of Central Management Services, working in
11consultation with the Director of any affected State agency,
12shall direct all new State employment positions which may be
13created under the Personnel Code, and which are not required
14by their nature or function to be located in a specific
15geographic area, to be located in Sangamon County.
16    (c) The Director shall determine a geographic location for
17each State employment position and, if it is other than
18Sangamon County, the reason for it to be in that geographic
19location. In determining whether to locate or relocate a State
20employment position to Sangamon County, the Director shall
21consult the Director of any affected State agency as to
22whether the nature or function of a position requires it to be
23located in a specific geographic area of the State. If no such
24geographic necessity exists, that position shall be located or
25relocated to Sangamon County.
26    (d) The rights of employees and the State and its agencies

1under the Personnel Code and applicable collective bargaining
2agreements with respect to the relocation of current State
3employee position holders shall not be affected by the
4provisions of this Section. The provisions of this Section
5regarding location or relocation of a position to Sangamon
6County shall apply only to State employment positions that
7become vacant or are created on or after the effective date of
8this amendatory Act of the 100th General Assembly.
9    (e) The provisions of this Section do not apply to: (1) any
10office of the legislative or judicial branch; (2) Statewide
11offices under the jurisdiction of any executive branch
12constitutional officer other than the Governor; or (3) persons
13employed directly by the Office of the Governor. This Section
14does apply to departments and agencies of State government
15under the jurisdiction of the Governor other than persons
16employed directly by the Office of the Governor.
17    (f) To the extent possible, any State employment positions
18and offices relocated under this Section shall be relocated to
19the City of Springfield, as the State capitol, and to downtown
20Springfield specifically. The Department is authorized to
21purchase real property in Springfield for the purposes of this
22subsection (f).

24    Section 15. The State Finance Act is amended by adding

4    Section 99. Effective date. This Act takes effect upon
5becoming law.
