    Amends the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985. Provides that, in determining compliance with continuing education requirements, the Department of Financial and Professional Regulation shall accept online continuing education that has a verified attendance system completed by a licensee before January 1, 2022. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Barber, Cosmetology, Esthetics, Hair
5Braiding, and Nail Technology Act of 1985 is amended by
6changing Sections 3-7, 3A-6, 3C-8, and 3E-5 as follows:

8    (Section scheduled to be repealed on January 1, 2026)
9    Sec. 3-7. Licensure; renewal; continuing education. The
10holder of a license issued under this Article III may renew
11that license during the month preceding the expiration date
12thereof by paying the required fee, giving such evidence as
13the Department may prescribe of completing not less than 14
14hours of continuing education for a cosmetologist, and 24
15hours of continuing education for a cosmetology teacher or
16cosmetology clinic teacher, within the 2 years prior to
17renewal. The training shall be in subjects approved by the
18Department as prescribed by rule upon recommendation of the
19Board and may include online instruction. In determining
20compliance with the continuing education requirements of this
21Section, the Department shall accept online continuing
22education that has a verified attendance system completed by a
23licensee before January 1, 2022.

1    For the initial renewal of a cosmetologist's license which
2requires continuing education, as prescribed by rule, one hour
3of the continuing education shall include domestic violence
4and sexual assault awareness education as prescribed by rule
5of the Department. For every subsequent renewal of a
6cosmetologist's license, one hour of the continuing education
7may include domestic violence and sexual assault awareness
8education as prescribed by rule of the Department. The
9one-hour domestic violence and sexual assault awareness
10continuing education course shall be provided by a continuing
11education provider approved by the Department, except that
12completion from March 12, 2016 to March 15, 2016 of a one-hour
13domestic violence and sexual assault awareness course from a
14domestic violence and sexual assault awareness organization
15shall satisfy this requirement.
16    The Department may prescribe rules regarding the
17requirements for domestic violence and sexual assault
18awareness continuing education courses and teachers.
19    The Department shall establish by rule a means for the
20verification of completion of the continuing education
21required by this Section. This verification may be
22accomplished through audits of records maintained by
23registrants, by requiring the filing of continuing education
24certificates with the Department, or by other means
25established by the Department.
26    The Department, in its discretion, may waive enforcement

1of the continuing education requirement in this Section,
2including the domestic violence and sexual assault awareness
3education requirement, and shall adopt rules defining the
4standards and criteria for that waiver under the following
5circumstances:
6        (a) the licensee resides in a locality where it is
7    demonstrated that the absence of opportunities for such
8    education would interfere with the ability of the licensee
9    to provide service to the public;
10        (b) that to comply with the continuing education
11    requirements would cause a substantial financial hardship
12    on the licensee;
13        (c) that the licensee is serving in the United States
14    Armed Forces; or
15        (d) that the licensee is incapacitated due to illness.

20    Sec. 3A-6. Licensure; renewal; continuing education;
21examination; military service. The holder of a license issued
22under this Article may renew such license during the month
23preceding the expiration date thereof by paying the required
24fee, giving evidence the Department may prescribe of

1less than 20 hours of continuing education for esthetics
2teachers, within the 2 years prior to renewal. The training
3shall be in subjects, approved by the Department as prescribed

7of the continuing education shall include domestic violence
8and sexual assault awareness education as prescribed by rule
9of the Department. For every subsequent renewal of an
10esthetician's license, one hour of the continuing education
11may include domestic violence and sexual assault awareness
12education as prescribed by rule of the Department. The
13one-hour domestic violence and sexual assault awareness
14continuing education course shall be provided by a continuing
15education provider approved by the Department, except that
16completion from March 12, 2016 to March 15, 2016 of a one-hour
17domestic violence and sexual assault awareness course from a
18domestic violence and sexual assault awareness organization

21    Sec. 3C-8. License renewal; expiration; continuing
22education; persons in military service. The holder of a
23license issued under this Article may renew that license
24during the month preceding the expiration date of the license

1Department may prescribe, of completing not less than 10 hours
2of continuing education for a nail technician and 20 hours of
3continuing education for a nail technology teacher, within the
42 years prior to renewal. The continuing education shall be in
5subjects approved by the Department upon recommendation of the
6Barber, Cosmetology, Esthetics, Hair Braiding, and Nail
7Technology Board relating to the practice of nail technology,
8including, but not limited to, review of sanitary procedures,
9review of chemical service procedures, review of this Act, and
10review of the Workers' Compensation Act. However, at least 10
11of the hours of continuing education required for a nail
12technology teacher shall be in subjects relating to teaching
13methodology, educational psychology, and classroom management
14or in other subjects related to teaching.
15    For the initial renewal of a nail technician's license
16which requires continuing education, as prescribed by rule,
17one hour of the continuing education shall include domestic
18violence and sexual assault awareness education as prescribed
19by rule of the Department. For every subsequent renewal of a
20nail technician's license, one hour of the continuing
21education may include domestic violence and sexual assault
22awareness education as prescribed by rule of the Department.
23The one-hour domestic violence and sexual assault awareness
24continuing education course shall be provided by a continuing
25education provider approved by the Department, except that

5    Sec. 3E-5. License renewal. To renew a license issued
6under this Article, an individual must produce proof of
7successful completion of 10 hours of continuing education for
8a hair braider license and 20 hours of continuing education
9for a hair braiding teacher license.
10    For the initial renewal of a hair braider's license which
11requires continuing education, as prescribed by rule, one hour
12of the continuing education shall include domestic violence
13and sexual assault awareness education as prescribed by rule
14of the Department. For every subsequent renewal of a hair
15braider's license, one hour of the continuing education may
16include domestic violence and sexual assault awareness
17education as prescribed by rule of the Department. The
18one-hour domestic violence and sexual assault awareness
19continuing education course shall be provided by a continuing
20education provider approved by the Department, except that
21completion from March 12, 2016 to March 15, 2016 of a one-hour
22domestic violence and sexual assault awareness course from a
23domestic violence and sexual assault awareness organization
24shall satisfy this requirement.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
