SYNOPSIS AS INTRODUCED:
 
20 ILCS 2630/3.2  from Ch. 38, par. 206-3.2

    Amends the Criminal Identification Act. Provides that when a person sustains injury as a victim of a crime and is treated by a medical facility or a physician or nurse and the person presents himself or herself as a victim of a sex offense or domestic violence, the local law enforcement agency shall only be notified by the medical facility, or any physician or nurse that treats the victim, if the victim requests or agrees to the notification. Provides that this exception does not change the obligations of mandated reporters under the Abused and Neglected Child Reporting Act. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Identification Act is amended by
5changing Section 3.2 as follows:
 
6    (20 ILCS 2630/3.2)  (from Ch. 38, par. 206-3.2)
7    Sec. 3.2. It is the duty of any person conducting or
8operating a medical facility, or any physician or nurse as
9soon as treatment permits to notify the local law enforcement
10agency of that jurisdiction upon the application for treatment
11of a person who is not accompanied by a law enforcement
12officer, when it reasonably appears that the person requesting
13treatment has received:
14        (1) any injury resulting from the discharge of a
15    firearm; or
16        (2) any injury sustained in the commission of or as a
17    victim of a criminal offense, except that when the person
18    presents himself or herself as a victim of a sex offense or
19    domestic violence, the local law enforcement agency shall
20    only be notified if the victim requests or agrees to the
21    notification. This exception does not change the
22    obligations of mandated reporters under the Abused and
23    Neglected Child Reporting Act.

1    Any hospital, physician or nurse shall be forever held
2harmless from any civil liability for their reasonable
3compliance with the provisions of this Section.
