SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.07

    Amends the Medical Assistance Article of the Illinois Public Aid Code. In a provision requiring the Department of Healthcare and Family Services to pay the DCFS per diem rate for inpatient psychiatric stays at free-standing psychiatric hospitals or hospitals with a pediatric or adolescent inpatient psychiatric unit, removes language making the provision operative only through July 1, 2023.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-5.07 as follows:
 
6    (305 ILCS 5/5-5.07)
7    Sec. 5-5.07. Inpatient psychiatric stay; DCFS per diem
8rate. The Department of Children and Family Services shall pay
9the DCFS per diem rate for inpatient psychiatric stay at a
10free-standing psychiatric hospital or a hospital with a
11pediatric or adolescent inpatient psychiatric unit effective
12the 11th day when a child is in the hospital beyond medical
13necessity, and the parent or caregiver has denied the child
14access to the home and has refused or failed to make provisions
15for another living arrangement for the child or the child's
16discharge is being delayed due to a pending inquiry or
17investigation by the Department of Children and Family
18Services. If any portion of a hospital stay is reimbursed
19under this Section, the hospital stay shall not be eligible
20for payment under the provisions of Section 14-13 of this
21Code. This Section is inoperative on and after July 1, 2021.
22Notwithstanding the provision of Public Act 101-209 stating
23that this Section is inoperative on and after July 1, 2020,
