SYNOPSIS AS INTRODUCED:
 
230 ILCS 5/56

    Amends the Illinois Horse Racing Act of 1975. Provides that the amount an organization licensee racing standardbred horses places in a purse account from gaming pursuant to an organization gaming license shall be held in reserve by the organization gaming licensee to be expended at the direction of the Illinois Standardbred Breeders Fund Advisory Board (rather than paid to the Illinois Standardbred Breeders Fund) and shall solely be used as authorized.

1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Horse Racing Act of 1975 is
5amended by changing Section 56 as follows:
 
6    (230 ILCS 5/56)
7    Sec. 56. Gaming pursuant to an organization gaming
8license.
9    (a) A person, firm, corporation, partnership, or limited
10liability company having operating control of a racetrack may
11apply to the Gaming Board for an organization gaming license.
12An organization gaming license shall authorize its holder to
13conduct gaming on the grounds of the racetrack of which the
14organization gaming licensee has operating control. Only one
15organization gaming license may be awarded for any racetrack.
16A holder of an organization gaming license shall be subject to
17the Illinois Gambling Act and rules of the Illinois Gaming
18Board concerning gaming pursuant to an organization gaming
19license issued under the Illinois Gambling Act. If the person,
20firm, corporation, or limited liability company having
21operating control of a racetrack is found by the Illinois
22Gaming Board to be unsuitable for an organization gaming
23license under the Illinois Gambling Act and rules of the

1Gaming Board, that person, firm, corporation, or limited
2liability company shall not be granted an organization gaming
3license. Each license shall specify the number of gaming
4positions that its holder may operate.
5    An organization gaming licensee may not permit patrons
6under 21 years of age to be present in its organization gaming
7facility, but the licensee may accept wagers on live racing
8and inter-track wagers at its organization gaming facility.
9    (b) For purposes of this subsection, "adjusted gross
10receipts" means an organization gaming licensee's gross
11receipts less winnings paid to wagerers and shall also include
12any amounts that would otherwise be deducted pursuant to
13subsection (a-9) of Section 13 of the Illinois Gambling Act.
14The adjusted gross receipts by an organization gaming licensee
15from gaming pursuant to an organization gaming license issued
16under the Illinois Gambling Act remaining after the payment of
17taxes under Section 13 of the Illinois Gambling Act shall be
18distributed as follows:
19        (1) Amounts shall be paid to the purse account at the
20    track at which the organization licensee is conducting
21    racing equal to the following:
22            12.75% of annual adjusted gross receipts up to and
23        including $93,000,000;
24            20% of annual adjusted gross receipts in excess of
25        $93,000,000 but not exceeding $100,000,000;
26            26.5% of annual adjusted gross receipts in excess

1        of $100,000,000 but not exceeding $125,000,000; and
2            20.5% of annual adjusted gross receipts in excess
3        of $125,000,000.
4        If 2 different breeds race at the same racetrack in
5    the same calendar year, the purse moneys allocated under
6    this subsection (b) shall be divided pro rata based on
7    live racing days awarded by the Board to that race track
8    for each breed. However, the ratio may not exceed 60% for
9    either breed, except if one breed is awarded fewer than 20
10    live racing days, in which case the purse moneys allocated
11    shall be divided pro rata based on live racing days.
12        (2) The remainder shall be retained by the
13    organization gaming licensee.
14    (c) Annually, from the purse account of an organization
15licensee racing thoroughbred horses in this State, except for
16in Madison County, an amount equal to 12% of the gaming
17receipts from gaming pursuant to an organization gaming
18license placed into the purse accounts shall be paid to the
19Illinois Thoroughbred Breeders Fund and shall be used for
20owner awards; a stallion program pursuant to paragraph (3) of
21subsection (g) of Section 30 of this Act; and Illinois
22conceived and foaled stakes races pursuant to paragraph (2) of
23subsection (g) of Section 30 of this Act, as specifically
24designated by the horsemen association representing the
25largest number of owners and trainers who race at the
26organization licensee's race meetings.

1    Annually, from the purse account of an organization
2licensee racing thoroughbred horses in Madison County, an
3amount equal to 10% of the gaming receipts from gaming
4pursuant to an organization gaming license placed into the
5purse accounts shall be paid to the Illinois Thoroughbred
6Breeders Fund and shall be used for owner awards; a stallion
7program pursuant to paragraph (3) of subsection (g) of Section
830 of this Act; and Illinois conceived and foaled stakes races
9pursuant to paragraph (2) of subsection (g) of Section 30 of
10this Act, as specifically designated by the horsemen
11association representing the largest number of owners and
12trainers who race at the organization licensee's race
13meetings.
14    Annually, from the amounts generated for purses from all
15sources, including, but not limited to, amounts generated from
16wagering conducted by organization licensees, organization
17gaming licensees, inter-track wagering licensees, inter-track
18wagering locations licensees, and advance deposit wagering
19licensees, or an organization licensee to the purse account of
20an organization licensee conducting thoroughbred races at a
21track in Madison County, an amount equal to 10% of adjusted
22gross receipts as defined in subsection (b) of this Section
23shall be paid to the horsemen association representing the
24largest number of owners and trainers who race at the
25organization licensee's race meets, to be used to for
26operational expenses and may be also used for after care

1programs for retired thoroughbred race horses, backstretch
2laundry and kitchen facilities, a health insurance or
3retirement program, the Future Farmers of America, and such
4other programs.
5    Annually, from the purse account of organization licensees
6conducting thoroughbred races at racetracks in Cook County,
7$100,000 shall be paid for division and equal distribution to
8the animal sciences department of each Illinois public
9university system engaged in equine research and education on
10or before the effective date of this amendatory Act of the
11101st General Assembly for equine research and education.
12    (d) Annually, from the purse account of an organization
13licensee racing standardbred horses, an amount equal to 15% of
14the gaming receipts from gaming pursuant to an organization
15gaming license placed into that purse account shall be held in
16reserve by the organization gaming licensee to be expended at
17the direction of the Illinois Standardbred Breeders Fund
18Advisory Board and shall solely paid to the Illinois
19Standardbred Breeders Fund. Moneys deposited into the Illinois
20Standardbred Breeders Fund shall be used for standardbred
21racing as authorized in paragraphs 1, 2, 3, 8, and 9 of
22subsection (g) of Section 31 of this Act and for bonus awards
23as authorized under paragraph 6 of subsection (j) of Section
2431 of this Act.
