SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/11E-132 new

    Amends the Conversion and Formation of School Districts Article of the School Code. Within 3 years after the effective date of the amendatory Act, requires elementary school districts to form new school districts but only with other elementary school districts and high school districts to form new school districts but only with other high school districts, notwithstanding any referendum requirements or any other laws to the contrary. Provides that the State Board of Education shall facilitate the creation of the new school districts by providing recommendations on which districts must consolidate. Sets forth the factors that the State Board must take into consideration. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
511E-132 as follows:
 
6    (105 ILCS 5/11E-132 new)
7    Sec. 11E-132. Elementary and high school district
8consolidation required. Within 3 years after the effective
9date of this amendatory Act of the 102nd General Assembly,
10elementary school districts shall form new school districts
11but only with other elementary school districts and high
12school districts shall form new school districts but only with
13other high school districts, notwithstanding any referendum
14requirements or any other laws to the contrary. The State
15Board of Education shall facilitate the creation of the new
16school districts by providing recommendations on which
17districts must consolidate. The State Board shall take into
18consideration the location of the affected districts in
19relationship to each other, the school needs and conditions of
20the affected districts and in the area adjacent to those
21districts, the classification of funds and assets that will
22result from the consolidation, the best interests of the
23schools of the affected districts, and the best interests and

1the educational welfare of the pupils residing in the affected
2districts.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.
