SYNOPSIS AS INTRODUCED:

55 ILCS 5/5-12001.4 new
60 ILCS 1/110-13 new
65 ILCS 5/11-13-1.3 new
    Amends the Counties Code, Township Code, and Illinois Municipal Code. Provides that a county, township, or municipality that has adopted regulations relating to the construction of new buildings must require a commercial or residential building with a skylight installed in a flat roof to include a safety screen or other barrier able to withstand, at a minimum, 500 pounds. Defines "skylight". Limits the concurrent exercise of home rule powers. Effective January 1, 2026.

1     AN ACT concerning local government.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Counties Code is amended by adding Section
5 5-12001.4 as follows:

6     (55 ILCS 5/5-12001.4 new)
7     Sec. 5-12001.4. Regulation of flat roof skylights.
8     (a) As used in this Section, "skylight" means a window
9 measuring 12 inches or more in its least dimension that is
10 installed in a roof.
11     (b) A county that has adopted regulations relating to the
12 construction of new buildings must require a commercial or
13 residential building with a skylight installed in a flat roof
14 to include a safety screen or other barrier able to withstand,
15 at a minimum, 500 pounds.
16     (c) A home rule county may not regulate flat roof
17 skylights in a manner inconsistent with this Section. This
18 Section is a limitation under subsection (i) of Section 6 of
19 Article VII of the Illinois Constitution on the concurrent
20 exercise by home rule units of powers and functions exercised
21 by the State.

22     Section 10. The Township Code is amended by adding Section

1 110-13 as follows:

2     (60 ILCS 1/110-13 new)
3     Sec. 110-13. Regulation of flat roof skylights.
4     (a) As used in this Section, "skylight" means a window
5 measuring 12 inches or more in its least dimension that is
6 installed in a roof.
7     (b) A township that has adopted regulations relating to
8 the construction of new buildings must require a commercial or
9 residential building with a skylight installed in a flat roof
10 to include a safety screen or other barrier able to withstand,
11 at a minimum, 500 pounds.

12     Section 15. The Illinois Municipal Code is amended by
13 adding Section 11-13-1.3 as follows:

14     (65 ILCS 5/11-13-1.3 new)
15     Sec. 11-13-1.3. Regulation of flat roof skylights.
16     (a) As used in this Section, "skylight" means a window
17 measuring 12 inches or more in its least dimension that is
18 installed in a roof.
19     (b) A municipality that has adopted regulations relating
20 to the construction of new buildings must require a commercial
21 or residential building with a skylight installed in a flat
22 roof to include a safety screen or other barrier able to
23 withstand, at a minimum, 500 pounds.

1     (c) A home rule municipality may not regulate flat roof
2 skylights in a manner inconsistent with this Section. This
3 Section is a limitation under subsection (i) of Section 6 of
4 Article VII of the Illinois Constitution

5     Section 99. Effective date. This Act takes effect January
6 1, 2026.
