SYNOPSIS AS INTRODUCED:
 
50 ILCS 205/30 new
50 ILCS 205/35 new

    Amends the Local Records Act. Provides that a unit of local government must compile a list of: (i) the pay and benefits of every employee, consultant, contractor, and other personnel of the unit of local government whose accumulated payments or compensation is at least $1,000 during a fiscal year; and (ii) each entity to which it directs a payment of more than $3,000 during a fiscal year, the amount of the payments, the address of the entity, and the product or service supplied by the entity. Provides that the lists must continue to be updated throughout the entire fiscal year by adding additional names of persons being paid at least $1,000 and for expenditures of government funds greater than $3,000. Provides that the unit of local government must publish on its website, if it has one, the compiled lists and must update the lists on the website at least annually. Provides that, if the unit of local government does not have a website, the unit of local government must publish the lists, on an annual basis, in a newspaper of general circulation in the county in which the unit of local government is located. Limits the concurrent exercise of home rule powers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Records Act is amended by adding
5Sections 30 and 35 as follows:
 
6    (50 ILCS 205/30 new)
7    Sec. 30. Compensation greater than $1,000.
8    (a) A unit of local government must compile and maintain a
9list of the pay and benefits of every employee, consultant,
10contractor, and other personnel of the unit of local
11government whose accumulated payments or compensation is at
12least $1,000 during a fiscal year. Material that is exempt
13from disclosure under the Freedom of Information Act may be
14excluded from the list. The list must be updated throughout
15the entire fiscal year by adding additional names of persons
16whose accumulated payments or compensation are at least
17$1,000.
18    (b) A unit of local government must publish on its
19website, if it has one, the public record compiled under
20subsection (a) and must update the list on the website at least
21annually. If the unit of local government does not have a
22website, the unit of local government must publish the list,
23on an annual basis, in a newspaper of general circulation in

1the county in which the unit of local government is located.
2    (c) Nothing in this Section shall be construed to require
3a unit of local government to compile or publish information
4about juror payments or juror compensation.
5    (d) A home rule unit may not compile, maintain, or publish
6a list of the pay and benefits of its personnel in a manner
7that is inconsistent with this Section. This Section is a
8limitation under subsection (i) of Section 6 of Article VII of
9the Illinois Constitution on the concurrent exercise by home
10rule units of powers and functions exercised by the State.

12    Sec. 35. Expenditures greater than $3,000.
13    (a) A unit of local government must compile and maintain a
14list of each entity to which it directs a payment of more than
15$3,000 during a fiscal year, the amount of the payment, the
16address of the entity, and the product or service supplied by
17the entity for the payment. Material that is exempt from
18disclosure under the Freedom of Information Act may be
19excluded from the list. The list must be updated throughout
20the entire fiscal year by adding additional names of entities
21to which the local government directs a payment of more than
22$3,000 during the fiscal year.
23    (b) A unit of local government must publish on its
24website, if it has one, the public record compiled under
25subsection (a) and must update the list on the website at least

1annually. If the unit of local government does not have a
2website, the unit of local government must publish the list,
