    Amends the Emergency Medical Services (EMS) Systems Act. Provides that the Legislature finds and declares that emergency medical services are essential services in the State of Illinois.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Emergency Medical Services (EMS) Systems Act
5is amended by changing Section 2 as follows:
 
6    (210 ILCS 50/2)  (from Ch. 111 1/2, par. 5502)
7    Sec. 2. Legislative intent; construction of Act. The
8Legislature finds and declares that emergency medical services
9are essential services in the State of Illinois and it is the
10intent of this legislation to provide the State with systems
11for emergency medical services by establishing within the State
12Department of Public Health a central authority responsible for
13the coordination and integration of all activities within the
14State concerning pre-hospital and inter-hospital emergency
15medical services, as well as non-emergency medical transports,
16and the overall planning, evaluation, and regulation of
17pre-hospital emergency medical services systems.
18    The provisions of this Act shall not be construed to deny
19emergency medical services to persons outside the boundaries of
20this State nor to limit, restrict, or prevent any cooperative
21agreement for the provision of emergency medical services
22between this State, or any of its political subdivisions, and
23any other State or its political subdivisions or a federal

1agency.
2    The provisions of this Act shall not be construed to
3regulate the emergency transportation of persons by friends or
4family members, in personal vehicles that are not ambulances,
5specialized emergency medical service vehicles, first response
6vehicles or medical carriers.
7    This legislation is intended to provide minimum standards
8for the statewide delivery of EMS services. It is recognized,
9however, that diversities exist between different areas of the
10State, based on geography, location of health care facilities,
11availability of personnel, and financial resources. The
12Legislature therefore intends that the implementation and
13enforcement of this Act by the Illinois Department of Public
14Health accommodate those varying needs and interests to the
15greatest extent possible without jeopardizing appropriate
16standards of medical care, through the Department's exercise of
17the waiver provision of this Act and its adoption of rules
18pursuant to this Act.
