SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/8.49

    Amends the State Finance Act. Provides that, as soon as may be practical after the effective date of the amendatory Act, and in no event later than July 1, 2013: (i) $1,000,000 shall be transferred from the General Revenue Fund to the DCEO Projects Fund, and (ii) $320,000 shall be transferred from the General Revenue Fund to the Coal Development Fund. Effective immediately.

2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by changing
5Section 8.49 as follows:
 
6    (30 ILCS 105/8.49)
7    Sec. 8.49. Special fund transfers.
8    (a) In order to maintain the integrity of special funds and
9improve stability in the General Revenue Fund, the following
10transfers are authorized from the designated funds into the
11General Revenue Fund:

21All of these transfers shall be made in equal quarterly
22installments with the first made on July 1, 2009, or as soon
23thereafter as practical, and with the remaining transfers to be
24made on October 1, January 1, and April 1, or as soon
25thereafter as practical. These transfers shall be made
26notwithstanding any other provision of State law to the

1contrary until June 30, 2010.
2    (b) On and after the effective date of this amendatory Act
3of the 96th General Assembly through June 30, 2010, when any of
4the funds listed in subsection (a) have insufficient cash from
5which the State Comptroller may make expenditures properly
6supported by appropriations from the fund, then the State
7Treasurer and State Comptroller shall transfer from the General
8Revenue Fund to the fund such amount as is immediately
9necessary to satisfy outstanding expenditure obligations on a
10timely basis, subject to the provisions of the State Prompt
11Payment Act.
12    (c) If the Director of the Governor's Office of Management
13and Budget determines that any transfer to the General Revenue
14Fund from a special fund under subsection (a) either (i)
15jeopardizes federal funding based on a written communication
16from a federal official or (ii) violates an order of a court of
17competent jurisdiction, then the Director may order the State
18Treasurer and State Comptroller, in writing, to transfer from
19the General Revenue Fund to that listed special fund all or
20part of the amounts transferred from that special fund under
21subsection (a).
22    (d) In addition to any other transfers that may be provided
23for by law, on December 1, 2010, or as soon thereafter as may
24be practical, the State Comptroller shall direct and the State
25Treasurer shall transfer the following amounts from the General
26Revenue Fund to the designated funds:

3    DHS Private Resources Fund....................$1,000,000
4    (e) In addition to any other transfers that may be provided
5for by law, as soon as may be practical after the effective
6date of this amendatory Act of the 98th General Assembly, and
7in no event later than July 1, 2013, the State Comptroller
8shall direct and the State Treasurer shall transfer the
9following amounts from the General Revenue Fund to the
10designated funds:
11        (1) DCEO Projects Fund....................$1,000,000
12        (2) Coal Development Fund...................$320,000

16    Section 99. Effective date. This Act takes effect upon
17becoming law.
