1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing Section
55-1028 as follows:
 
6    (55 ILCS 5/5-1028)  (from Ch. 34, par. 5-1028)
7    Sec. 5-1028. Tax for emergency ambulance service;
8referendum. In any county which is not a home rule county, a
9county board may levy and collect, annually, a tax of not to
10exceed .25% of the value, as equalized or assessed by the
11Department of Revenue, of all the taxable property in the
12county not included within the territory of a fire protection
13district which levies a tax for ambulance service, for the
14payment of expenses not paid for from general funds which are
15incurred in providing emergency ambulance service under the
16provisions of Section 5-1053. Such tax shall not be included
17within any statutory limitation of rate or amount for other
18county purposes, but shall be excluded therefrom and be in
19addition thereto and in excess thereof.
20    This tax shall not be levied in any county until the
21question of its adoption is submitted to the electors of the
22county not residing within the territory of a fire protection
23district which levies a tax for ambulance service and approved

1by a majority of those voting on the question. Upon the
2adoption of a resolution by the county board providing for the
3submission of the question of the adoption to the electors of
4the county the board shall certify the resolution and the
5proposition to the proper election officials who shall submit
6the proposition at an election in accordance with the general
7election law. If a majority of the votes cast on the question
8is in favor of the levy of such tax, it may thereafter be
9levied in such county for each succeeding year.
10    Notwithstanding any other provision of this Section, the
11county board of a county that has more than 8,400 but less than
129,000 inhabitants, according to the 2010 federal decennial
13census, may also use funds collected under this Section to
14provide 9-1-1 service, but only if the question of using those
15funds for that purpose has been submitted to the electors of
16the county not residing within the territory of the fire
17protection district that levies the tax for ambulance service
18and if that question is approved by a majority of those
19electors voting on the question. Upon the adoption of a
20resolution by the county board providing for the submission of
21that question to those electors, the board shall certify the
22resolution and the proposition to the proper election
23officials, who shall submit the proposition at an election in
24accordance with the Election Code. The election authority must
25submit the question in substantially the following form:

1    May moneys collected by the county
2to provide emergency ambulance service           YES
3also be used for the purpose of -----------------------------
4providing 9-1-1 service?                          NO

6    The election authority must record the votes as "Yes" or
7"No".
8    If a majority of the electors voting on the question vote
9in the affirmative, the county may thereafter use funds that it
10collects under this Section to provide 9-1-1 service or
11emergency ambulance service.

13    Section 99. Effective date. This Act takes effect January
