SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/11-4.2  from Ch. 46, par. 11-4.2

    Amends the Election Code. Provides that no building or part of a building shall be designated or used as a polling place if spirituous or intoxicating liquor is sold anywhere on the premises.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
511-4.2 as follows:
 
6    (10 ILCS 5/11-4.2)  (from Ch. 46, par. 11-4.2)
7    Sec. 11-4.2. (a) Except as otherwise provided in subsection
8(b) all polling places shall be accessible to handicapped and
9elderly voters, as determined by rule of the State Board of
10Elections.
11    (b) Subsection (a) of this Section shall not apply to a
12polling place (1) in the case of an emergency, as determined by
13the State Board of Elections; or (2) if the State Board of
14Elections (A) determines that all potential polling places have
15been surveyed and no such accessible place is available, nor is
16the election authority able to make one accessible; and (B)
17assures that any handicapped or elderly voter assigned to an
18inaccessible polling place, upon advance request of such voter
19(pursuant to procedures established by rule of the State Board
20of Elections) will be provided with an alternative means for
21casting a ballot on the day of the election or will be assigned
22to an accessible polling place.
23    (c) No later than December 31 of each even numbered year,

1the State Board of Elections shall report to the Federal
2Election Commission the number of accessible and inaccessible
3polling places in the State on the date of the next preceding
4general election, and the reasons for any instance of
5inaccessibility.
6    (d) No building or part of a building shall be designated
7or used as a polling place if spirituous or intoxicating liquor
8is sold anywhere on the premises.
