HOUSE RESOLUTION

WHEREAS, The 32nd Representative District ranks in the top 3 of Representative Districts reporting incidents of violent crimes; and

WHEREAS, The boundaries of the 32nd Representative District are generally in the inner city of Chicago spanning to the southwest suburbs of Burbank, Bridgeview, Hickory Hills, and Justice, Illinois; and

WHEREAS, The Chicago Police Department statistics indicate that portions of the city, within the 32nd Representative District, including the Chicago Police Department 7th District's Englewood community and 3rd District's Park Manor neighborhood, are some of the most violent communities in the City of Chicago; and

WHEREAS, From January through September 22, 2013 within the Englewood community there have been 33 murders and 24 murders surrounding the Park Manor neighborhood according to the Chicago Police Department's crime portal; and

WHEREAS, Residents of the 32nd Representative District of the State of Illinois have petitioned to have the State of Illinois enter into an Intergovernmental Cooperative Agreement with the City of Chicago to deploy the Illinois Department of State Police to patrol certain boundaries of the 32nd Representative District of the State of Illinois, for a reasonable period of time; and

WHEREAS, There are over 600 signatories to the petition who are all registered voters in the 32nd District within those boundaries; and

WHEREAS, Section 16 of the State Police Act (20 ILCS 2610/16) gives officers of the Department of State Police statewide jurisdiction, consequently, Illinois State Police officers can enforce the laws of the State of Illinois anywhere within its boundaries in cooperation with local officers; and

WHEREAS, The City of Chicago is willing and authorized to make an official request for assistance to the Department of State Police, through an Intergovernmental Cooperative Agreement, to have Illinois State Police Officers patrol areas within the 32nd Representative District; and

WHEREAS, Subsection (c) of Section 10 of Article VII of the Constitution of the State of Illinois dealing with Local Government and Intergovernmental Cooperation states that "The State shall encourage intergovernmental cooperation and use its technical and financial resources to assist intergovernmental activities"; and

WHEREAS, The Illinois State Police have been patrolling expressways in Chicago for over 25 years, under a November 1985 Intergovernmental Cooperative Agreement entered into by Governor James Thompson and Mayor Harold Washington; and

WHEREAS, The Intergovernmental Cooperative Agreement allows the State to sell State Lottery tickets at 6 designated kiosks at Chicago O'Hare International Airport and subsequently at Midway International Airport, in exchange for State Police patrolling expressways in the city, including the Dan Ryan Expressway, at no additional cost to the City or State; and

WHEREAS, The Dan Ryan Expressway is that portion of I-94 located in the City of Chicago spanning from 95th Street to Roosevelt Road; and

WHEREAS, The Dan Ryan Expressway travels through the 32nd District one linear mile from 67th Street to 76th Street; and

WHEREAS, Within the 32nd Representative District lies Halsted Street one mile west of the Dan Ryan Expressway and Cottage Grove Avenue one mile east of the Dan Ryan Expressway; which encompasses the community of Englewood and Park Manor neighborhood; and

WHEREAS, Consistent with the 1985 Intergovernmental Cooperative Agreement, the State of Illinois has generated $4,939,990 in Fiscal Year 2013 from lottery sales at Chicago O'Hare International Airport and $696,776 in Fiscal Year 2013 from lottery sales at Midway International Airport; and

WHEREAS, The State of Illinois has generated additional monies for fines imposed on drivers operating along Chicago expressways; and

WHEREAS, The State of Illinois receives monies by the imposition of fines and penalties for those improperly operating motor vehicles on the Dan Ryan Expressway between 67th Street and 76th Street; and

WHEREAS, The State of Illinois derives financial profits directly from the Illinois Lottery kiosks located at O'Hare and Midway Airports; and

WHEREAS, The Illinois State Lottery is managed by Northstar Lottery Group which exponentially surpassed the past years goals of the Illinois Lottery, thereby deriving substantial profits for the Illinois State Lottery; and

WHEREAS, It will not be a financial burden on the State of Illinois for the Illinois State Police to expand its patrol area, solely from the Dan Ryan Expressway between 67th Street and 76th Street one linear mile east and one linear mile west, to support efforts at combating violent crime in the State of Illinois; and

WHEREAS, Over 600 registered voters within the 2 mile rectangular radius of the Dan Ryan Expressway between 67th Street and 76th Street have signed a petition imploring the Governor of the State of Illinois to dispatch the Illinois State Police to that specific area within the 32nd Representative District; and

WHEREAS, Over 600 residents of the 32nd District have stated that they are in immediate need of assistance and relief in the efforts to combat violent crime in the State of Illinois; and

WHEREAS, It is necessary and appropriate for the City of Chicago to enter into an Intergovernmental Cooperative Agreement with the State of Illinois to deploy Illinois State Police inwards from the Chicago expressways for approximately one linear mile between 67th and 76th streets to Halsted Avenue to the West and Cottage Grove Avenue to the East, for the health, safety, and welfare of its residents; therefore, be it

RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the City of Chicago and the State of Illinois to enter into an Intergovernmental Cooperative Agreement to deploy Illinois State Police inwards from the Chicago expressways for approximately one linear mile between 67th and 76th streets to Halsted Avenue to the West and Cottage Grove Avenue to the East, for the health, safety, and welfare of its residents; and be it further

RESOLVED, That suitable copies of this resolution be forwarded to the Director of State Police and the Mayor of the City of Chicago.
