SYNOPSIS AS INTRODUCED:

720 ILCS 5/17-5.8 new

Amends the Criminal Code of 2012. Provides that any person legally authorized to treat, transport, or store human remains, except as authorized by law, shall not: (1) knowingly and intentionally provide inaccurate documentation of the identity of human remains to an individual or organization; (2) knowingly and intentionally store human remains in violation of Illinois law; or (3) knowingly and intentionally provide an individual or organization with human remains that are intentionally misidentified. Provides that a violation is a Class 4 felony.

A BILL FOR

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Criminal Code of 2012 is amended by adding Section 17-5.8 as follows:

(720 ILCS 5/17-5.8 new)

Sec. 17-5.8. Mishandling of human remains.

(a) Any person legally authorized to treat, transport, or store human remains, except as authorized by law, shall not:

(1) knowingly and intentionally provide inaccurate documentation of the identity of human remains to an individual or organization;

(2) knowingly and intentionally store human remains in violation of Illinois law; or

(3) knowingly and intentionally provide an individual or organization with human remains that are intentionally misidentified.

(b) Sentence. A person who violates this Section is guilty of a Class 4 felony.
