SYNOPSIS AS INTRODUCED:

Amends the Illinois Highway Code. Provides for the establishment and administration of the Township Rebuild Program by the Department of Transportation. Provides that the Department use the Township Rebuild Fund to award grants of no greater than $250,000 to townships with populations under 2,000 for the purpose of expanding machinery storage facilities. Amends the Motor Fuel Tax Law. Creates the Township Rebuild Fund as a special fund in the State Treasury. Provides that the Fund shall receive transfers from the Motor Fuel Tax Fund sufficient to provide awards to all eligible townships in the Illinois Township Rebuild Program. Amends the State Finance Act to make a corresponding addition. Provides that the Township Rebuild Program Fund shall be used according to the purposes described in the Transportation Funds provisions of the Revenue Article of the Illinois Constitution.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Finance Act is amended by adding Section 5.1015 as follows:

Sec. 5.1015. The Township Rebuild Program Fund.

Section 10. The Motor Fuel Tax Law is amended by adding Section 8c as follows:

Sec. 8c. Township Rebuild Program Fund; creation; distribution of proceeds. The Township Rebuild Program Fund is hereby created as a special fund in the State treasury. The Fund shall receive transfers from the Motor Fuel Tax Fund sufficient to provide awards to all eligible townships. Moneys in the Fund shall be used by the Department of Transportation to provide grants to townships with populations under 2,000 in amounts not greater than $250,000 for the purposes of building or expanding machinery storage facilities. Moneys in the Township Rebuild Program Fund shall be used according to the purposes described in Section 11 of Article IX of the Illinois Constitution of 1970.

Section 15. The Illinois Highway Code is amended by adding Section 6-703 as follows:

Sec. 6-703. Township Rebuild Program created.

(a) Following the effective date of this amendatory Act of the 103rd General Assembly, the Department shall administer the Illinois Township Rebuild Program. The Department shall adopt all necessary rules to administer the Program.

(b) The Department shall use moneys of the Township Rebuild Program Fund as created under Section 8c of the Motor Fuel Tax Law to review applicants and award grants to townships with populations under 2,000 for the purpose of expanding machinery storage facilities. Awards shall be distributed based on availability and shall be not greater than $250,000. Eligibility shall be determined by the Department and established through rules adopted by the Department. Moneys in the Township Rebuild Program Fund shall be used according to the purposes described in Section 11 of Article IX of the Illinois Constitution of 1970.
