| Amends the Food Handling Regulation Enforcement Act. In provisions requiring each food service establishment to be under the operational supervision of a certified food service sanitation manager in accordance with rules adopted under the Act, provides that "operational supervision" means oversight of a food service establishment by a food service sanitation manager with or without the physical presence of the food service sanitation manager at the food service establishment. |

| 1 | | AN ACT concerning health. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 5. The Food Handling Regulation Enforcement Act is | 5 | | amended by changing Section 3 as follows: | 6 | | (410 ILCS 625/3) (from Ch. 56 1/2, par. 333) | 7 | | Sec. 3. Each food service establishment shall be under the | 8 | | operational supervision of a certified food service sanitation | 9 | | manager in accordance with rules adopted promulgated under | 10 | | this Act. As used in this paragraph, "operational supervision" | 11 | | means oversight of a food service establishment by a food | 12 | | service sanitation manager with or without the physical | 13 | | presence of the food service sanitation manager at the food | 14 | | service establishment. | 15 | | By July 1, 1990, the Director of the Department of Public | 16 | | Health in accordance with this Act, shall promulgate rules for | 17 | | the education, examination, and certification of food service | 18 | | establishment managers and instructors of the food service | 19 | | sanitation manager certification education programs. Beginning | 20 | | January 1, 2018, any individual who has completed a minimum of | 21 | | 8 hours of Department-approved training for food service | 22 | | sanitation manager certification, inclusive of the | 23 | | examination, and received a passing score on the examination |

| 1 | | set by the certification exam provider accredited under | 2 | | standards developed and adopted by the Conference for Food | 3 | | Protection or its successor organization, shall be considered | 4 | | to be a certified food service sanitation manager. Beginning | 5 | | January 1, 2018, any individual who has completed a minimum of | 6 | | 8 hours of Department-approved training for food service | 7 | | sanitation manager instructor certification, inclusive of the | 8 | | examination, and received a passing score on the examination | 9 | | set by the certification exam provider accredited under | 10 | | standards developed and adopted by the Conference for Food | 11 | | Protection or its successor organization, shall be considered | 12 | | to be a certified food service sanitation manager instructor. | 13 | | A food service sanitation manager certificate and a food | 14 | | service sanitation manager instructor certificate issued by | 15 | | the exam provider shall be valid for 5 years and shall not be | 16 | | transferable from the individual to whom it was issued. A food | 17 | | service sanitation manager certificate issued by the | 18 | | Department under this Section before January 1, 2018 is valid | 19 | | until the expiration date stated on the certificate. | 20 | | For purposes of food service sanitation manager | 21 | | certification, the Department shall accept only training | 22 | | approved by the Department and certification exams accredited | 23 | | under standards developed and adopted by the Conference for | 24 | | Food Protection or its successor. | 25 | | (Source: P.A. 99-62, eff. 7-16-15; 100-194, eff. 1-1-18; | 26 | | 100-954, eff. 8-19-18.) |
