1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Pesticide Application at Schools Act.
 
6    Section 5. Legislative findings. The General Assembly
7finds that:
8        (1) schools throughout the State treat school property
9    with pesticides in order to reduce risks to students from
10    noxious weeds, such as thistle, poison ivy, pests,
11    allergies, disease bearing insects, and activities on
12    unlevel playing surfaces;
13        (2) unless properly applied in accordance with the
14    United States Environmental Protection Agency's pesticide
15    labels, schools may inadvertently expose children to
16    pesticides; and
17        (3) it is the purpose of this Act to minimize student
18    exposure to pesticides.
 
19    Section 10. Definition. As used in this Act, "school day"
20has the same meaning given to that term in Section 300.11 of
21the federal Individuals with Disabilities Education Act.

1    Section 15. Pesticide application prohibited. Beginning
2July 1, 2024, a school serving students grades kindergarten
3through 8th grade is prohibited from scheduling pesticide
4applications on school grounds during the school day,
5including during a partial day, when students are in
6attendance at school for instructional purposes. Areas
7prohibited from treatment include paved surfaces, playgrounds,
8and playing fields. This Section shall not apply to areas of
9school grounds where children are not typically present,
10including, but not limited to, flower beds and lawns
11surrounding the school not used as playing fields.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
