| 1 | | AN ACT concerning education. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 5. The School Code is amended by changing Section | 5 | | 34-4 as follows: | 6 | | (105 ILCS 5/34-4) (from Ch. 122, par. 34-4) | 7 | | Sec. 34-4. Eligibility. To be eligible for election or | 8 | | appointment to the board, a person shall be a citizen of the | 9 | | United States, shall be a registered voter as provided in the | 10 | | Election Code, shall have been a resident of the city and, if | 11 | | applicable, the electoral district, for at least one year | 12 | | immediately preceding his or her election or appointment, and | 13 | | shall not be a child sex offender as defined in Section 11-9.3 | 14 | | of the Criminal Code of 2012. A person is ineligible for | 15 | | election or appointment to the board if that person is an | 16 | | employee of the school district. All persons eligible for | 17 | | election to the board shall be nominated by a petition signed | 18 | | by no less than 250 voters residing within the electoral | 19 | | district on a petition in order to be placed on the ballot, | 20 | | except that persons eligible for election to the board at | 21 | | large shall be nominated by a petition signed by no less than | 22 | | 2,500 voters residing within the city. | 1 | | constitutes a resignation therefrom and creates a vacancy in | 2 | | the board. The board may, by resolution, provide for the | 3 | | compensation of board members. The compensation provided for | 4 | | board members may include, but is not limited to, | 5 | | reimbursement Board members shall serve without any | 6 | | compensation; however, board members shall be reimbursed for | 7 | | expenses incurred while in the performance of their duties | 8 | | upon submission of proper receipts or upon submission of a | 9 | | signed voucher in the case of an expense allowance evidencing | 10 | | the amount of such reimbursement or allowance to the president | 11 | | of the board for verification and approval. Board members | 12 | | shall not hold other public office under the Federal, State or | 13 | | any local government other than that of Director of the | 14 | | Regional Transportation Authority, member of the economic | 15 | | development commission of a city having a population exceeding | 16 | | 500,000, notary public or member of the National Guard, and by | 17 | | accepting any such office while members of the board, or by not | 18 | | resigning any such office held at the time of being elected or | 19 | | appointed to the board within 30 days after such election or | 20 | | appointment, shall be deemed to have vacated their membership | 21 | | in the board. | 22 | | (Source: P.A. 102-177, eff. 6-1-22; 102-691, eff. 12-17-21 .) |
