1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. This Act may be referred to as the Deputy Chief
5Pete Bendinelli PFAS PPE Act.
 
6    Section 5. The PFAS Reduction Act is amended by changing
7Section 5 and by adding Section 20 as follows:
 
8    (415 ILCS 170/5)
9    Sec. 5. Definitions. In this Act, unless the context
10otherwise requires:
11    "Agency" means the Illinois Environmental Protection
12Agency.
13    "Auxiliary firefighting personal protective equipment"
14means personal protective equipment other than firefighting
15personal protective clothing, including self-contained
16breathing apparatuses and other respiratory protection
17products, hearing protection, protective communication
18devices, and fall protection products.
19    "Class B firefighting foam" means foam designed to
20extinguish flammable liquid fires or prevent the ignition of
21flammable liquids.
22    "Fire department" means the duly authorized fire

1protection organization of a unit of local government, a
2Regional Fire Protection Agency, a fire protection district,
3or a volunteer fire department.
4    "Firefighting personal protective clothing" means any
5clothing designed, intended, or marketed to be worn by
6firefighting personnel in the performance of their duties,
7designed with the intent for use in fire and rescue
8activities, including jackets, pants, shoes, gloves, and
9helmets.
10    "Local government" means a unit of local government or
11other special purpose district that provides firefighting
12services.
13    "Manufacturer" means a person that manufactures Class B
14firefighting foam and any agents of that person, including an
15importer, distributor, authorized servicer, factory branch, or
16distributor branch.
17    "Perfluoroalkyl substance or polyfluoroalkyl substance" or
18"PFAS" means a class of fluorinated organic chemicals
19containing at least one fully fluorinated carbon atom.
20    "Person" means any individual, partnership, association,
21public or private corporation, limited liability company, or
22any other type of legal or commercial entity, including, but
23not limited to, members, managers, partners, directors, or
24officers.
25    "Testing" means calibration testing, conformance testing,
26and fixed system testing.

2    (415 ILCS 170/20 new)
3    Sec. 20. Notification for firefighting personal protective
4clothing and equipment sales; prohibitions.
5    (a) Beginning January 1, 2026, any person, firm,
6association, partnership, corporation, organization, or joint
7venture, including an importer or domestic distributor of
8firefighting agents or firefighting equipment, that sells
9firefighting personal protective clothing containing PFAS
10chemicals to any person, local government, or State agency
11shall provide written notice to the purchaser at the time of
12sale which shall state: (i) that the firefighting personal
13protective clothing contains PFAS chemicals; and (ii) the
14reason PFAS chemicals are added to the clothing. The seller
15and the purchaser shall retain a copy of the notice required
16under this subsection on file for at least 3 years from the
17date of the purchase, and upon the request of the Agency, the
18seller shall furnish the notice, or written copies, and
19associated sales documentation to the Agency within 60 days of
20such request.
21    (b) Beginning January 1, 2027, a person that sells
22firefighting personal protective clothing to any person, local
23government, or State agency shall not knowingly manufacture,
24sell, offer for sale, distribute for sale, or distribute for
25use in the State any firefighting personal protective clothing

1containing intentionally added PFAS chemicals.
2    (c) Beginning January 1, 2030, a person that sells
3auxiliary firefighting personal protective equipment to any
4person, local government, or State agency shall not knowingly
5manufacture, sell, offer for sale, distribute for sale, or
6distribute for use in the State any auxiliary firefighting
7personal protective equipment containing intentionally added
8PFAS chemicals.
