| 1 | | AN ACT concerning safety. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 1. This Act may be referred to as the Deputy Chief | 5 | | Pete Bendinelli PFAS PPE Act. | 6 | | Section 5. The PFAS Reduction Act is amended by changing | 7 | | Section 5 and by adding Section 20 as follows: | 8 | | (415 ILCS 170/5) | 9 | | Sec. 5. Definitions. In this Act , unless the context | 10 | | otherwise requires : | 11 | | "Agency" means the Illinois Environmental Protection | 12 | | Agency. | 13 | | "Auxiliary firefighting personal protective equipment" | 14 | | means personal protective equipment other than firefighting | 15 | | personal protective clothing, including self-contained | 16 | | breathing apparatuses and other respiratory protection | 17 | | products, hearing protection, protective communication | 18 | | devices, and fall protection products. | 19 | | "Class B firefighting foam" means foam designed to | 20 | | extinguish flammable liquid fires or prevent the ignition of | 21 | | flammable liquids. | 22 | | "Fire department" means the duly authorized fire |

| 1 | | protection organization of a unit of local government, a | 2 | | Regional Fire Protection Agency, a fire protection district, | 3 | | or a volunteer fire department. | 4 | | "Firefighting personal protective clothing" means any | 5 | | clothing designed, intended, or marketed to be worn by | 6 | | firefighting personnel in the performance of their duties, | 7 | | designed with the intent for use in fire and rescue | 8 | | activities, including jackets, pants, shoes, gloves, and | 9 | | helmets. | 10 | | "Local government" means a unit of local government or | 11 | | other special purpose district that provides firefighting | 12 | | services. | 13 | | "Manufacturer" means a person that manufactures Class B | 14 | | firefighting foam and any agents of that person, including an | 15 | | importer, distributor, authorized servicer, factory branch, or | 16 | | distributor branch. | 17 | | "Perfluoroalkyl substance or polyfluoroalkyl substance" or | 18 | | "PFAS" means a class of fluorinated organic chemicals | 19 | | containing at least one fully fluorinated carbon atom. | 20 | | "Person" means any individual, partnership, association, | 21 | | public or private corporation, limited liability company, or | 22 | | any other type of legal or commercial entity, including, but | 23 | | not limited to, members, managers, partners, directors, or | 24 | | officers. | 25 | | "Testing" means calibration testing, conformance testing, | 26 | | and fixed system testing. |

Notification for firefighting personal protective | 4 | | clothing and equipment sales; prohibitions. | 5 | | (a) Beginning January 1, 2026, any person, firm, | 6 | | association, partnership, corporation, organization, or joint | 7 | | venture, including an importer or domestic distributor of | 8 | | firefighting agents or firefighting equipment, that sells | 9 | | firefighting personal protective clothing containing PFAS | 10 | | chemicals to any person, local government, or State agency | 11 | | shall provide written notice to the purchaser at the time of | 12 | | sale which shall state: (i) that the firefighting personal | 13 | | protective clothing contains PFAS chemicals; and (ii) the | 14 | | reason PFAS chemicals are added to the clothing. The seller | 15 | | and the purchaser shall retain a copy of the notice required | 16 | | under this subsection on file for at least 3 years from the | 17 | | date of the purchase, and upon the request of the Agency, the | 18 | | seller shall furnish the notice, or written copies, and | 19 | | associated sales documentation to the Agency within 60 days of | 20 | | such request. | 21 | | (b) Beginning January 1, 2027, a person that sells | 22 | | firefighting personal protective clothing to any person, local | 23 | | government, or State agency shall not knowingly manufacture, | 24 | | sell, offer for sale, distribute for sale, or distribute for | 25 | | use in the State any firefighting personal protective clothing |

| 1 | | containing intentionally added PFAS chemicals. | 2 | | (c) Beginning January 1, 2030, a person that sells | 3 | | auxiliary firefighting personal protective equipment to any | 4 | | person, local government, or State agency shall not knowingly | 5 | | manufacture, sell, offer for sale, distribute for sale, or | 6 | | distribute for use in the State any auxiliary firefighting | 7 | | personal protective equipment containing intentionally added | 8 | | PFAS chemicals. |
