1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Sexual Assault Survivors Emergency
5Treatment Act is amended by changing Section 5.2 as follows:
 
6    (410 ILCS 70/5.2)
7    Sec. 5.2. Sexual assault services voucher.
8    (a) A sexual assault services voucher shall be issued by a
9treatment hospital, treatment hospital with approved pediatric
10transfer, or approved pediatric health care facility at the
11time a sexual assault survivor receives medical forensic
12services.
13    (b) Each treatment hospital, treatment hospital with
14approved pediatric transfer, and approved pediatric health
15care facility must include in its sexual assault treatment
16plan submitted to the Department in accordance with Section 2
17of this Act a protocol for issuing sexual assault services
18vouchers. The protocol shall, at a minimum, include the
19following:
20        (1) Identification of employee positions responsible
21    for issuing sexual assault services vouchers.
22        (2) Identification of employee positions with access
23    to the Medical Electronic Data Interchange or successor

1    system.
2        (3) A statement to be signed by each employee of an
3    approved pediatric health care facility with access to the
4    Medical Electronic Data Interchange or successor system
5    affirming that the Medical Electronic Data Interchange or
6    successor system will only be used for the purpose of
7    issuing sexual assault services vouchers.
8    (c) A sexual assault services voucher may be used to seek
9payment for any ambulance services, medical forensic services,
10laboratory services, pharmacy services, and follow-up
11healthcare provided as a result of the sexual assault.
12    (c-5) Beginning January 1, 2026, after services are
13provided to a survivor as a result of a sexual assault, a
14sexual assault services voucher may be used to seek payment
15for transportation to the hospital the survivor initially
16presented at, the survivor's residence, or a survivor services
17shelter by taxi or rideshare services, if available. A
18hospital may obtain written consent of the survivor to use
19taxi or rideshare services arranged by the hospital.
20    (d) Any treatment hospital, treatment hospital with
21approved pediatric transfer, approved pediatric health care
22facility, health care professional, ambulance provider,
23laboratory, or pharmacy may submit a bill for services
24provided to a sexual assault survivor as a result of a sexual
25assault to the Department of Healthcare and Family Services
26Sexual Assault Emergency Treatment Program. The bill shall

1include:
2        (1) the name and date of birth of the sexual assault
3    survivor;
4        (2) the service provided;
5        (3) the charge of service;
6        (4) the date the service was provided; and
7        (5) the recipient identification number, if known.
8    A health care professional, ambulance provider,
9laboratory, or pharmacy is not required to submit a copy of the
10sexual assault services voucher.
11    The Department of Healthcare and Family Services Sexual
12Assault Emergency Treatment Program shall electronically
13verify, using the Medical Electronic Data Interchange or a
14successor system, that a sexual assault services voucher was
15issued to a sexual assault survivor prior to issuing payment
16for the services.
17    If a sexual assault services voucher was not issued to a
18sexual assault survivor by the treatment hospital, treatment
19hospital with approved pediatric transfer, or approved
20pediatric health care facility, then a health care
21professional, ambulance provider, laboratory, or pharmacy may
22submit a request to the Department of Healthcare and Family
23Services Sexual Assault Emergency Treatment Program to issue a
24sexual assault services voucher.
25    (e) This Section is effective on and after January 1,
262024.
