 1        AN ACT in relation to fire fighters.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Fire  Investigation  Act is amended by
 5    adding Section 9f as follows:

 6        (425 ILCS 25/9f new)
 7        Sec. 9f. The owner or occupier of the premises and his or
 8    her agents owe fire fighters who are on the premises  in  the
 9    performance   of   their   official  duties  conducting  fire
10    investigations or inspections or responding to fire alarms or
11    actual fires on the premises a duty of reasonable care in the
12    maintenance of the  premises  according  to  applicable  fire
13    safety   codes,   regulations,   ordinances,   and  generally
14    applicable safety standards, including any decisions  by  the
15    Illinois  courts.  The  owner or occupier of the premises and
16    his or her agents are not relieved of the duty of  reasonable
17    care  if  the  fire  fighter  is  injured  due to the lack of
18    maintenance of the premises in the course of responding to  a
19    fire,  false alarm, or his or her inspection or investigation
20    of the premises.
21        For purposes of this Section, the term  "premises"  means
22    any building or structure or the real property upon which the
23    building or structure is situated.
24        This  Section  applies  to all causes of action that have
25    accrued, will accrue, or are currently pending before a court
26    of competent jurisdiction, including courts of review.

27        Section 99.  Effective date.  This Act takes effect  upon
28    becoming law.
