 1        AN ACT relating to facility planning areas.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  1.  Short  title.   This Act may be cited as the
 5    Facility Planning Area Rules Act.

 6        Section 5.  Definitions.  For the purposes of this Act:
 7        "Facility planning area" means  an  area  as  defined  in
 8    paragraph 2.33 of the Illinois Water Quality Management Plan.
 9        "Resource  protection  plan"  is  any  plan  adopted by a
10    public agency that includes goals, policies, strategies,  and
11    procedures   for  preserving  key  farmland,  natural  areas,
12    cultural resources, or aquatic resources.

13        Section 10.  Rules. Within one year of the  enactment  of
14    this  Act, the Illinois Environmental Protection Agency shall
15    propose rules related to facilities planning that  take  into
16    account  the findings and recommendations of (1) its Facility
17    Planning Area  Stakeholder  Group  and  (2)  studies  of  the
18    facilities  planning  area  program, including those findings
19    and recommendations related  to:  nonpoint  source  pollution
20    management,   construction   site   runoff,   urban   runoff,
21    consistency  with  antidegradation  regulations, alternatives
22    analysis,  interagency  coordination,   alternative   dispute
23    resolution,  and consistency with local, county, and regional
24    land use plans and resource protection plans.

25        Section 90.  Repealer.  This Act is repealed  on  January
26    1, 2007.

27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law.
