1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Local Government Taxpayer's Relief Act.
6 Section 5. Legislative findings. The General Assembly
7 finds that taxpayers who finance the operations of local
8 governments are unfairly burdened by unscrupulous lawsuits
9 filed by plaintiffs where the plaintiffs' revenues are also
10 subsidized by local governments through taxpayer-funded
11 contracts. The purpose of this Act is to terminate public
12 funds from being used to finance lawsuits against the
13 taxpayer. Suits against local government as must be
14 financed without taxpayer funds.
15 Section 10. Definition. In this Act
16 "Person" means an individual, corporation, vendor,
17 business trust, partnership, association, or any other
18 business entity, and includes representatives and agents of
19 that person.
20 Section 15. Prohibited contracts. No person may bid,
21 transact, continue to perform, or have any interest in a
22 contract or agreement let or issued by a unit of local
23 government or school district if that person has filed a
24 civil lawsuit naming that unit of local government or school
25 district as a defendant unless approved by the executive and
26 a majority of the legislative branch of the unit of local
27 government.
28 Section 20. Applicability.

1 (a) This Act applies to units of local government,
2 including home rule units, and school districts. This Act
3 does not apply to the State or to any office, officer,
4 department, division, bureau, board, commission, university,
5 or other agency of the State.
6 (b) This Act applies to all contracts and agreements
7 entered into before, on, or after the effective date of this
8 Act.
9 (c) This Act does not apply to any contract or agreement
10 between an employee and employer as defined in Title 29,
11 Chapter 18, Subchapter I, Subtitle A, Section 1002 of the
12 United States Code.
13 Section 25. Home rule. A home rule unit may not act in a
14 manner inconsistent with the provisions of this Act. This
15 Section is a limitation under subsection (i) of Section 6 of
16 Article VII of the Illinois Constitution on the concurrent
17 exercise by home rule units of powers and functions exercised
18 by the State.
19 Section 99. Effective date. This Act takes effect upon
20 becoming law.
