 1        AN ACT in relation to criminal law.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Criminal  Code  of  1961  is amended by
 5    adding Section 12-4.10 as follows:

 6        (720 ILCS 5/12-4.10 new)
 7        Sec. 12-4.10.  Endangering the  life  and  health  of  an
 8    emergency service provider.
 9        (a)  A person commits the offense of endangering the life
10    and  health  of an emergency service provider if an emergency
11    service  provider  experiences  death,  great  bodily   harm,
12    disability,  or  disfigurement  as  a  result  of  entering a
13    structure containing a clandestine drug  laboratory  designed
14    or  intended  to  produce an unlawful controlled substance or
15    designed or intended  to  produce  ingredients  used  in  the
16    manufacture of an unlawful controlled substance.
17        (b)  In this Section:
18        "Emergency  service  provider"  means  a peace officer, a
19    firefighter, an emergency  medical  technician-ambulance,  an
20    emergency   medical-technician-intermediate,   an   emergency
21    medical  technician-paramedic,  an  ambulance driver or other
22    medical or first aid personnel.
23        "Structure" means any house,  apartment  building,  shop,
24    barn,   warehouse,  building,  vessel,  railroad  car,  cargo
25    container, motor vehicle, housecar, trailer,  trailer  coach,
26    camper,   mine,  floating  home,  watercraft,  any  structure
27    capable of holding  a  clandestine  laboratory  or  any  real
28    property.
29        (c)  Sentence.   Endangering  the  life  and health of an
30    emergency service provider is a Class X felony.

 1        Section 99.  Effective date.  This Act takes effect  upon
 2    becoming law.
