 1        AN ACT concerning counties.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Counties  Code  is  amended  by  adding
 5    Section 5-1062.2 as follows:

 6        (55 ILCS 5/5-1062.2 new)
 7        Sec.  5-1062.2.  Sediment and erosion control program. In
 8    accordance with the EPA Phase II requirements for development
 9    of   sediment   and   erosion   control    regulations    and
10    post-construction  run-off  control, the county board of each
11    county may adopt,  implement,  and  enforce  a  sediment  and
12    erosion  control program to mitigate the effects of increased
13    stormwater run-off due to new  development  or  redevelopment
14    within  the  county.  Additionally,  the  county  may adopt a
15    schedule of fees as necessary  to  mitigate  the  effects  of
16    increased stormwater runoff. The fees may not exceed the cost
17    of  satisfying  the on-site stormwater retention or detention
18    requirements of the adopted stormwater management  plan.  The
19    fees shall be held in a separate fund and may be used only to
20    adopt,  implement,  and  enforce  the  sediment  and  erosion
21    control program.

22        Section  99.  Effective date.  This Act takes effect upon
23    becoming law.
