 1        AN ACT concerning insurance.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois  Insurance  Code is amended by
 5    changing Section 370b as follows:

 6        (215 ILCS 5/370b) (from Ch. 73, par. 982b)
 7        Sec.     370b.  Reimbursement     on     equal     basis.
 8    Notwithstanding any provision  of  any  individual  or  group
 9    policy  of accident and health insurance, or any provision of
10    a policy, contract, plan or agreement for hospital or medical
11    service or indemnity, wherever such policy, contract, plan or
12    agreement provides for reimbursement for any service provided
13    by persons licensed under the Medical Practice Act of 1987 or
14    under the Podiatric Medical Practice Act of 1987, the  person
15    entitled to benefits or person performing services under such
16    policy,   contract,   plan   or   agreement  is  entitled  to
17    reimbursement on an equal basis for such  service,  when  the
18    service  is  performed by a person licensed under the Medical
19    Practice Act of 1987 or the Podiatric Medical Practice Act of
20    1987.  The provisions of this Section do  not  apply  to  any
21    policy,  contract,  plan  or  agreement  in  effect  prior to
22    September 19, 1969 or to preferred provider  arrangements  or
23    benefit agreements.
