 1        AN ACT concerning procurement.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Procurement Code is  amended  by
 5    adding Section 30-22 as follows:

 6        (30 ILCS 500/30-22 new)
 7        Sec.  30-22.  Direct  payments  to  subcontractors  pilot
 8    project.
 9        (a)  The  Illinois  Department  of  Transportation  shall
10    conduct  a  pilot  project  to  commence January 1, 2004. The
11    pilot project will provide direct payments by  the  State  to
12    subcontractors   for  construction  work.  Upon  satisfactory
13    completion of any subcontractor's portion  of  the  contract,
14    the State shall pay the subcontractor directly.
15        (b)  Upon successful completion of the pilot project, the
16    Illinois  Department  of  Transportation  shall  implement  a
17    subcontractors   direct  pay  program  for  all  construction
18    projects.

19        Section 99.  Effective date.  This Act takes effect  upon
20    becoming law.
