1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 15-111 as follows:
 
6     (625 ILCS 5/15-111)  (from Ch. 95 1/2, par. 15-111)
7     Sec. 15-111. Wheel and axle loads and gross weights.
8     (a) On non-designated highways, no vehicle or combination
9 of vehicles equipped with pneumatic tires may be operated,
10 unladen or with load, when the total weight transmitted to the
11 road surface exceeds 18,000 pounds on a single axle or 32,000
12 pounds on a tandem axle with no axle within the tandem
13 exceeding 18,000 pounds except:
14         (1) when a different limit is established and posted in
15 accordance with Section 15-316 of this Code;
16         (2) vehicles for which the Department of
17 Transportation and local authorities issue overweight
18 permits under authority of Section 15-301 of this Code;
19         (3) tow trucks subject to the conditions provided in
20 subsection (d) may not exceed 24,000 pounds on a single
21 rear axle or 44,000 pounds on a tandem rear axle;
22         (4) any single axle of a 2-axle truck weighing 36,000
23 pounds or less and not a part of a combination of vehicles,
24 shall not exceed 20,000 pounds;
25         (5) any single axle of a 2-axle truck equipped with a
26 personnel lift or digger derrick, weighing 36,000 pounds or
27 less, owned and operated by a public utility, shall not
28 exceed 20,000 pounds;
29         (6) any single axle of a 2-axle truck specially
30 equipped with a front loading compactor used exclusively
31 for garbage, refuse, or recycling may not exceed 20,000
32 pounds per axle, provided that the gross weight of the

1 vehicle does not exceed 40,000 pounds;
2         (7) a truck, not in combination and specially equipped
3 with a selfcompactor or an industrial roll-off hoist and
4 roll-off container, used exclusively for garbage or refuse
5 operations may, when laden, transmit upon the road surface
6 the following maximum weights: 22,000 pounds on a single
7 axle; 40,000 pounds on a tandem axle;
8         (8) a truck, not in combination and used exclusively
9 for the collection of rendering materials, may, when laden,
10 transmit upon the road surface the following maximum
11 weights: 22,000 pounds on a single axle; 40,000 pounds on a
12 tandem axle;
13         (9) tandem axles on a 3-axle truck registered as a
14 Special Hauling Vehicle, manufactured prior to or in the
15 model year of 2014 and first registered in Illinois prior
16 to January 1, 2015, with a distance greater than 72 inches
17 but not more than 96 inches between any series of 2 axles,
18 is allowed a combined weight on the series not to exceed
19 36,000 pounds and neither axle of the series may exceed
20 18,000 pounds. Any vehicle of this type manufactured after
21 the model year of 2014 or first registered in Illinois
22 after December 31, 2014 may not exceed a combined weight of
23 32,000 pounds through the series of 2 axles and neither
24 axle of the series may exceed 18,000 pounds;
25         (10) tandem axles on a 4-axle truck mixer, whose fourth
26 axle is a road surface engaging mixer trailing axle,
27 registered as a Special Hauling Vehicle, used exclusively
28 for the mixing and transportation of concrete and
29 manufactured prior to or in the model year of 2014 and
30 first registered in Illinois prior to January 1, 2015, with
31 a distance greater than 72 inches but not more than 96
32 inches between any series of 2 axles, is allowed the
33 following maximum weights: 20,000 pounds on any single
34 axle; 36,000 pounds on any series of 2 axles greater than
35 72 inches but not more than 96 inches; and 34,000 pounds on
36 any series of 2 axles greater than 40 inches but not more

1 than 72 inches a combined weight on the series not to
2 exceed 36,000 pounds and neither axle of the series may
3 exceed 18,000 pounds. Any vehicle of this type manufactured
4 after the model year of 2014 or first registered in
5 Illinois after December 31, 2014 may not exceed a combined
6 weight of 32,000 pounds through the series of 2 axles and
7 neither axle of the series may exceed 18,000 pounds;
8         (11) 4-axle vehicles or a 5 or more axle combination of
9 vehicles: The weight transmitted upon the road surface
10 through any series of 3 axles whose centers are more than
11 96 inches apart, measured between extreme axles in the
12 series, may not exceed those allowed in the table contained
13 in subsection (f) of this Section. No axle or tandem axle
14 of the series may exceed the maximum weight permitted under
15 this Section for a single or tandem axle.
16     No vehicle or combination of vehicles equipped with other
17 than pneumatic tires may be operated, unladen or with load,
18 upon the highways of this State when the gross weight on the
19 road surface through any wheel exceeds 800 pounds per inch
20 width of tire tread or when the gross weight on the road
21 surface through any axle exceeds 16,000 pounds.
22     (b) On non-designated highways, the gross weight of
23 vehicles and combination of vehicles including the weight of
24 the vehicle or combination and its maximum load shall be
25 subject to the foregoing limitations and further shall not
26 exceed the following gross weights dependent upon the number of
27 axles and distance between extreme axles of the vehicle or
28 combination measured longitudinally to the nearest foot.

18     A 4-axle truck mixer registered as a Special Hauling
19 Vehicle, used exclusively for mixing and transportation of
20 concrete, and manufactured before or in the model year of 2014
21 and first registered in Illinois before January 1, 2015, is
22 allowed a maximum gross weight listed in the table of
23 subsection (f) of this Section for 4 axles. This vehicle is not
24 subject to the series of 3 axles requirement provided for in
25 subdivision (a)(11) of this Section.
26     (c) Cities having a population of more than 50,000 may
27 permit by ordinance axle loads on 2 axle motor vehicles 33 1/2%
28 above those provided for herein, but the increase shall not
29 become effective until the city has officially notified the
30 Department of the passage of the ordinance and shall not apply
31 to those vehicles when outside of the limits of the city, nor
32 shall the gross weight of any 2 axle motor vehicle operating

1 over any street of the city exceed 40,000 pounds.
2     (d) Weight limitations shall not apply to vehicles
3 (including loads) operated by a public utility when
4 transporting equipment required for emergency repair of public
5 utility facilities or properties or water wells.
6     A combination of vehicles, including a tow truck and a
7 disabled vehicle or disabled combination of vehicles, that
8 exceeds the weight restriction imposed by this Code, may be
9 operated on a public highway in this State provided that
10 neither the disabled vehicle nor any vehicle being towed nor
11 the tow truck itself shall exceed the weight limitations
12 permitted under this Chapter. During the towing operation,
13 neither the tow truck nor the vehicle combination shall exceed
14 24,000 pounds on a single rear axle and 44,000 pounds on a
15 tandem rear axle, provided the towing vehicle:
16         (1) is specifically designed as a tow truck having a
17 gross vehicle weight rating of at least 18,000 pounds and
18 is equipped with air brakes, provided that air brakes are
19 required only if the towing vehicle is towing a vehicle,
20 semitrailer, or tractor-trailer combination that is
21 equipped with air brakes;
22         (2) is equipped with flashing, rotating, or
23 oscillating amber lights, visible for at least 500 feet in
24 all directions;
25         (3) is capable of utilizing the lighting and braking
26 systems of the disabled vehicle or combination of vehicles;
27 and
28         (4) does not engage in a tow exceeding 20 miles from
29 the initial point of wreck or disablement. Any additional
30 movement of the vehicles may occur only upon issuance of
31 authorization for that movement under the provisions of
32 Sections 15-301 through 15-319 of this Code.
33     Gross weight limits shall not apply to the combination of
34 the tow truck and vehicles being towed. The tow truck license
35 plate must cover the operating empty weight of the tow truck
36 only. The weight of each vehicle being towed shall be covered

1 by a valid license plate issued to the owner or operator of the
2 vehicle being towed and displayed on that vehicle. If no valid
3 plate issued to the owner or operator of that vehicle is
4 displayed on that vehicle, or the plate displayed on that
5 vehicle does not cover the weight of the vehicle, the weight of
6 the vehicle shall be covered by the third tow truck plate
7 issued to the owner or operator of the tow truck and
8 temporarily affixed to the vehicle being towed.
9     The Department may by rule or regulation prescribe
10 additional requirements. However, nothing in this Code shall
11 prohibit a tow truck under instructions of a police officer
12 from legally clearing a disabled vehicle, that may be in
13 violation of weight limitations of this Chapter, from the
14 roadway to the berm or shoulder of the highway. If in the
15 opinion of the police officer that location is unsafe, the
16 officer is authorized to have the disabled vehicle towed to the
17 nearest place of safety.
18     For the purpose of this subsection, gross vehicle weight
19 rating, or GVWR, shall mean the value specified by the
20 manufacturer as the loaded weight of the tow truck.
21     (e) No vehicle or combination of vehicles equipped with
22 pneumatic tires shall be operated, unladen or with load, upon
23 the highways of this State in violation of the provisions of
24 any permit issued under the provisions of Sections 15-301
25 through 15-319 of this Chapter.
26     (f) On designated Class I, II, or III highways and the
27 National System of Interstate and Defense Highways, no vehicle
28 or combination of vehicles with pneumatic tires may be
29 operated, unladen or with load, when the total weight on the
30 road surface exceeds the following: 20,000 pounds on a single
31 axle; 34,000 pounds on a tandem axle with no axle within the
32 tandem exceeding 20,000 pounds; 80,000 pounds gross weight for
33 vehicle combinations of 5 or more axles; or a total weight on a
34 group of 2 or more consecutive axles in excess of that weight
35 produced by the application of the following formula: W = 500
36 times the sum of (LN divided by N-1) + 12N + 36, where "W"

1 equals overall total weight on any group of 2 or more
2 consecutive axles to the nearest 500 pounds, "L" equals the
3 distance measured to the nearest foot between extremes of any
4 group of 2 or more consecutive axles, and "N" equals the number
5 of axles in the group under consideration.
6     The above formula when expressed in tabular form results in

1 exceed 34,000 pounds, notwithstanding the higher limit
2 resulting from the application of the formula.
3     Vehicles not in a combination having more than 4 axles may
4 not exceed the weight in the table in this subsection (f) for 4
5 axles measured between the extreme axles of the vehicle.
6     Vehicles in a combination having more than 6 axles may not
7 exceed the weight in the table in this subsection (f) for 6
8 axles measured between the extreme axles of the combination.
9     Local authorities, with respect to streets and highways
10 under their jurisdiction, without additional fees, may also by
11 ordinance or resolution allow the weight limitations of this
12 subsection, provided the maximum gross weight on any one axle
13 shall not exceed 20,000 pounds and the maximum total weight on
14 any tandem axle shall not exceed 34,000 pounds, on designated
15 highways when appropriate regulatory signs giving notice are
16 erected upon the street or highway or portion of any street or
17 highway affected by the ordinance or resolution.
18     The following are exceptions to the above formula:
19         (1) Two consecutive sets of tandem axles may carry a
20 total weight of 34,000 pounds each if the overall distance
21 between the first and last axles of the consecutive sets of
22 tandem axles is 36 feet or more.
23         (2) Vehicles for which a different limit is established
24 and posted in accordance with Section 15-316 of this Code.
25         (3) Vehicles for which the Department of
26 Transportation and local authorities issue overweight
27 permits under authority of Section 15-301 of this Code.
28 These vehicles are not subject to the bridge formula.
29         (4) Tow trucks subject to the conditions provided in
30 subsection (d) may not exceed 24,000 pounds on a single
31 rear axle or 44,000 pounds on a tandem rear axle.
32         (5) A tandem axle on a 3-axle truck registered as a
33 Special Hauling Vehicle, manufactured prior to or in the
34 model year of 2014, and registered in Illinois prior to
35 January 1, 2015, with a distance between 2 axles in a
36 series greater than 72 inches but not more than 96 inches

1 may not exceed a total weight of 36,000 pounds and neither
2 axle of the series may exceed 18,000 pounds.
3         (6) A truck not in combination, equipped with a self
4 compactor or an industrial roll-off hoist and roll-off
5 container, used exclusively for garbage or refuse
6 operations, may, when laden, transmit upon the road
7 surface, except when on part of the National System of
8 Interstate and Defense Highways, the following maximum
9 weights: 22,000 pounds on a single axle; 40,000 pounds on a
10 tandem axle; 36,000 pounds gross weight on a 2-axle
11 vehicle; 54,000 pounds gross weight on a 3-axle vehicle.
12 This vehicle is not subject to the bridge formula.
13         (7) Combinations of vehicles, registered as Special
14 Hauling Vehicles that include a semitrailer manufactured
15 prior to or in the model year of 2014, and registered in
16 Illinois prior to January 1, 2015, having 5 axles with a
17 distance of 42 feet or less between extreme axles, may not
18 exceed the following maximum weights: 18,000 pounds on a
19 single axle; 32,000 pounds on a tandem axle; and 72,000
20 pounds gross weight. This combination of vehicles is not
21 subject to the bridge formula. For all those combinations
22 of vehicles that include a semitrailer manufactured after
23 the effective date of this amendatory Act of the 92nd
24 General Assembly, the overall distance between the first
25 and last axles of the 2 sets of tandems must be 18 feet 6
26 inches or more. Any combination of vehicles that has had
27 its cargo container replaced in its entirety after December
28 31, 2014 may not exceed the weights allowed by the bridge
29 formula.
30         (8) A 4-axle truck mixer registered as a Special
31 Hauling Vehicle, used exclusively for the mixing and
32 transportation of concrete and manufactured before or in
33 the model year of 2014 and first registered in Illinois
34 before January 1, 2015, and not operated on a highway that
35 is part of the National System of Interstate Highways, is
36 allowed the following maximum weights; 20,000 pounds on any

1 single axle; 36,000 pounds on a series of axles greater
2 than 72 inches but not more than 96 inches; and 34,000
3 pounds on any series of axles greater than 40 inches but
4 not more than 72 inches. The gross weight of this vehicle
5 may not exceed the weights allowed by the bridge formula
6 for 4 axles. The bridge formula does not apply to any
7 series of 3 axles.
8     No vehicle or combination of vehicles equipped with other
9 than pneumatic tires may be operated, unladen or with load,
10 upon the highways of this State when the gross weight on the
11 road surface through any wheel exceeds 800 pounds per inch
12 width of tire tread or when the gross weight on the road
13 surface through any axle exceeds 16,000 pounds.
14     (f-1) A vehicle and load not exceeding 73,280 pounds is
15 allowed access as follows:
16         (1) From any State designated highway onto any county,
17 township, or municipal highway for a distance of 5 highway
18 miles for the purpose of loading and unloading, provided:
19             (A) The vehicle and load does not exceed 8 feet 6
20 inches in width and 65 feet overall length.
21             (B) There is no sign prohibiting that access.
22             (C) The route is not being used as a thoroughfare
23 between State designated highways.
24         (2) From any State designated highway onto any county
25 or township highway for a distance of 5 highway miles, or
26 any municipal highway for a distance of one highway mile
27 for the purpose of food, fuel, repairs, and rest, provided:
28             (A) The vehicle and load does not exceed 8 feet 6
29 inches in width and 65 feet overall length.
30             (B) There is no sign prohibiting that access.
31             (C) The route is not being used as a thoroughfare
32 between State designated highways.
33     (f-2) A vehicle and load greater than 73,280 pounds in
34 weight but not exceeding 80,000 pounds is allowed access as
35 follows:
36         (1) From a Class I highway onto any street or highway

1 for a distance of one highway mile for the purpose of
2 loading, unloading, food, fuel, repairs, and rest,
3 provided there is no sign prohibiting that access.
4         (2) From a Class I, II, or III highway onto any State
5 highway or any local designated highway for a distance of 5
6 highway miles for the purpose of loading, unloading, food,
7 fuel, repairs, and rest.
8     Section 5-35 of the Illinois Administrative Procedure Act
9 relating to procedures for rulemaking shall not apply to the
10 designation of highways under this subsection.
11     (g) No person shall operate a vehicle or combination of
12 vehicles over a bridge or other elevated structure constituting
13 part of a highway with a gross weight that is greater than the
14 maximum weight permitted by the Department, when the structure
15 is sign posted as provided in this Section.
16     (h) The Department upon request from any local authority
17 shall, or upon its own initiative may, conduct an investigation
18 of any bridge or other elevated structure constituting a part
19 of a highway, and if it finds that the structure cannot with
20 safety to itself withstand the weight of vehicles otherwise
21 permissible under this Code the Department shall determine and
22 declare the maximum weight of vehicles that the structures can
23 withstand, and shall cause or permit suitable signs stating
24 maximum weight to be erected and maintained before each end of
25 the structure. No person shall operate a vehicle or combination
26 of vehicles over any structure with a gross weight that is
27 greater than the posted maximum weight.
28     (i) Upon the trial of any person charged with a violation
29 of subsections (g) or (h) of this Section, proof of the
30 determination of the maximum allowable weight by the Department
31 and the existence of the signs, constitutes conclusive evidence
32 of the maximum weight that can be maintained with safety to the
33 bridge or structure.
