SYNOPSIS AS INTRODUCED:

New Act

Creates the Firewall Protection Act. Provides that all multi-family structures containing 3 or more living units or any living units in a structure containing any type of commercial activity shall be constructed with separation walls, floors, and roofs with a minimum 2-hour fire rating. Denies home rule powers.

A BILL FOR

AN ACT concerning fire safety.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Firewall Protection Act.

Section 5. Firewalls. All multi-family structures containing 3 or more living units or any living unit in a structure containing any type of commercial activity shall be constructed with separation walls, floors, and roofs with a minimum 2-hour fire rating.

Section 10. Home rule. The regulation of firewalls is an exclusive power and function of the State. A home rule unit may not regulate firewalls. This Section is a denial and limitation of home rule powers and functions under subsection (h) of Section 6 of Article VII of the Illinois Constitution.
