 1        AN ACT in relation to criminal law.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Criminal  Code  of  1961  is  amended  by
 5    changing Section 11-23 as follows:

 6        (720 ILCS 5/11-23)
 7        Sec.  11-23.  Posting  of  identifying  information  with
 8    pornography on the on a pornographic Internet site.
 9        (a)  A  person  at least 17 years of age who discloses on
10    the an adult obscenity or child pornography Internet site the
11    name, address, telephone  number,  or  e-mail  address  of  a
12    person  along  with  adult  obscenity  or  child  pornography
13    involving  a  person under 17 years of age at the time of the
14    commission of the offense or of a person at least 17 years of
15    age without the consent of the person at least  17  years  of
16    age  is  guilty  of  the  offense  of  posting of identifying
17    information  with  pornography  on  the  on  a   pornographic
18    Internet site.
19        (b)  Sentence.   A  person  who  violates this Section is
20    guilty of a Class 4 felony if the victim is at least 17 years
21    of age at the time of the offense and a Class 3 felony if the
22    victim is under 17 years of age at the time of the offense.
23        (c)  Definitions.  For purposes of this Section:
24             (1)  "Adult obscenity or child pornography  Internet
25        site" means a site on the Internet that contains material
26        that  is obscene as defined in Section 11-20 of this Code
27        or that  is  child  pornography  as  defined  in  Section
28        11-20.1 of this Code.
29             (2)  "Internet"   includes   the   World  Wide  Web,
30        electronic mail, a news group posting, or  Internet  file
31        transfer.
