| AN ACT in relation to governmental records.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 1. Short title. This Act may be cited as the Social |
| 5 |
| Security Number Protection Task Force Act.
|
| 6 |
| Section 5. Findings. The General Assembly finds as follows: |
| 7 |
| (1) Identity theft is a major and growing problem in |
| 8 |
| the United States and in Illinois. |
| 9 |
| (2) An individual's social security number is a primary |
| 10 |
| means of identifying the individual, and the unauthorized |
| 11 |
| disclosure of the individual's social security number |
| 12 |
| creates a substantial risk that the individual's identity |
| 13 |
| may be stolen. |
| 14 |
| (3) Certain State officers and agencies require |
| 15 |
| individuals to disclose their social security numbers for |
| 16 |
| various reasons, thus creating the potential for the theft |
| 17 |
| of those individuals' identities if their social security |
| 18 |
| numbers are further disclosed without authorization. |
| 19 |
| (4) The State should take all necessary steps to ensure |
| 20 |
| that the procedures used by its officers and agencies do |
| 21 |
| not facilitate the theft of individuals' identities |
| 22 |
| through the unauthorized disclosure of those individuals' |
| 23 |
| social security numbers.

| 24 |
| Section 10. Social Security Number Protection Task Force. |
| 25 |
| (a) The Social Security Number Protection Task Force is |
| 26 |
| created. The Task Force shall consist of the following members: |
| 27 |
| (1) One member representing the House of |
| 28 |
| Representatives, appointed by the Speaker of the House of |
| 29 |
| Representatives; |
| 30 |
| (2) One member representing the House of |
| 31 |
| Representatives, appointed by the Minority Leader of the |

| (3) One member representing the Senate, appointed by |
| 3 |
| the President of the Senate; |
| 4 |
| (4) One member representing the Senate, appointed by |

| the Minority Leader of the Senate; |
| 6 |
| (5) One member representing the Office of the Attorney |
| 7 |
| General, appointed by the Attorney General; |
| 8 |
| (6) One member representing the Office of the Secretary |
| 9 |
| of State, appointed by the Secretary of State; |
| 10 |
| (7) One member representing the Office of the Governor, |
| 11 |
| appointed by the Governor; |
| 12 |
| (8) One member representing the Department of Natural |
| 13 |
| Resources, appointed by the Director of Natural Resources; |
| 14 |
| (9) One member representing the Department of Public |
| 15 |
| Aid, appointed by the Director of Public Aid; |
| 16 |
| (10) One member representing the Department of |
| 17 |
| Revenue, appointed by the Director of Revenue; |
| 18 |
| (11) One member representing the Department of State |
| 19 |
| Police, appointed by the Director of State Police; and
|
| 20 |
| (12) One member representing the Department of |
| 21 |
| Employment Security, appointed by the Director of |
| 22 |
| Employment Security. |
| 23 |
| (b) The Task Force shall examine the procedures used by the |
| 24 |
| State to protect an individual against the unauthorized |
| 25 |
| disclosure of his or her social security number when the State |
| 26 |
| requires the individual to provide his or her social security |
| 27 |
| number to an officer or agency of the State. |
| 28 |
| (c) The Task Force shall report its findings and |
| 29 |
| recommendations to the Governor, the Attorney General, the |
| 30 |
| Secretary of State, and the General Assembly no later than the |
| 31 |
| first day of the 2004 fall veto session of the 93rd General |
| 32 |
| Assembly.

| 33 |
| Section 99. Effective date. This Act takes effect upon |
| 34 |
| becoming law.
