1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 12-709 as follows:
 
6     (625 ILCS 5/12-709)  (from Ch. 95 1/2, par. 12-709)
7     Sec. 12-709. Display of slow-moving vehicle emblem.
8     (a) Every animal drawn vehicle, farm tractor, implement of
9 husbandry and special mobile equipment, when operated on a
10 highway must display a slow-moving vehicle emblem mounted on
11 the rear except as provided in paragraph (b) of this Section.
12 Special mobile equipment is exempt when operated within the
13 limits of a construction or maintenance project where traffic
14 control devices are used in compliance with the applicable
15 provisions of the manual and specifications adopted under
16 Section 11-301 of the "Illinois Vehicle Code".
17     (b) Every vehicle or unit described in paragraph (a) of
18 this Section when operated in combination on a highway must
19 display a slow-moving vehicle emblem as follows:
20         1. Where the towed unit or any load thereon partially
21     or totally obscures the slow-moving vehicle emblem on the
22     towing unit, the towed unit shall be equipped with a
23     slow-moving vehicle emblem. In such cases the towing unit
24     need not display the emblem.
25         2. Where the slow-moving vehicle emblem on the towing
26     unit is not obscured by the towed unit or its load, then
27     either or both may be equipped with the required emblem but
28     it shall be sufficient if either displays it.
29         3. A registered truck towed behind a farm tractor in
30     conformity with the provisions of Section 11-1418 of the
31     "Illinois Vehicle Code" must display a slow-moving vehicle
32     emblem in the manner provided in paragraph (c) while being

1     towed on a highway if the emblem on the towing vehicle is
2     partially or totally obscured.
3     (c) The slow-moving vehicle emblem required by paragraphs
4 (a) and (b) of this Section must meet or exceed the
5 specifications and mounting requirements established by the
6 Department. Such specifications and mounting requirements
7 shall, on and before August 31, 2004, be based on the
8 specifications adopted by the American Society of Agricultural
9 Engineers and published by that body as ASAE S 276.2 dated
10 March, 1968 or as ASAE S 276.5. On and after September 1, 2004,
11 the specifications and mounting requirements shall be based on
12 the specifications adopted by the American Society of
13 Agricultural Engineers and published by that body as ASAE S
14 276.5 NOV 97. No advertising or other marking shall appear upon
15 the emblem except that specified by the American Society of
16 Agricultural Engineers to identify the standard to which the
17 material complies. Each original package containing a
18 slow-moving vehicle emblem shall display a notice on the
19 outside of the package stating that such emblem shall only be
20 used for the purposes stated in subsections (a) and (b).
21     (d) A slow-moving vehicle emblem is intended as a safety
22 identification device and shall not be displayed on any vehicle
23 nor displayed in any manner other than as described in
24 paragraphs (a), (b) and (c) of this Section. A violation of
25 this subsection (d) is a petty offense punishable by a fine of
26 $25 for the first offense and $75 for a second or subsequent
27 offense within one year of the first offense.
