1     AN ACT in relation to health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Inclusion of Women and Minorities in
5 Clinical Research Act is amended by changing Sections 5 and 10
6 as follows:
 
7     (30 ILCS 785/5)
8     Sec. 5. Definitions. In this Act:
9     "Grantee" means any qualified public, private, or
10 not-for-profit agency or individual, including, but not
11 limited to, a college, university, hospital, laboratory,
12 research institution, local health department, voluntary
13 health agency, health maintenance organization, corporation,
14 student, fellow, or entrepreneur, conducting clinical research
15 using State funds. A grantee may also be a corporation that is
16 headquartered in Illinois and that conducts research using
17 State funds.
18     "Minority group" means a group that is a readily
19 identifiable subset of the U.S. population that is
20 distinguished by racial, ethnic, or cultural heritage. The
21 following racial and ethnic categories shall be used as
22 guidelines:
23         (1) "American Indian or Alaskan Native" means a person
24     having origins in any of the original native peoples of
25     North America and who maintains a cultural identification
26     through tribal affiliation or community recognition.
27         (2) "Asian or Pacific Islander" means a person having
28     origins in any of the original peoples of the Far East,
29     Southeast Asia, the Indian subcontinent, or the Pacific
30     Islands, including, but not limited to, China, India,
31     Japan, Korea, the Philippine Islands, and Samoa.
32         (3) "Black" means someone not of Hispanic origin having

1     origins in any of the black racial groups of Africa.
2         (4) "Hispanic" means a person of Mexican, Puerto Rican,
3     Cuban, Central or South American, or other Spanish culture
4     or origin, regardless of race is defined as in the 2000
5     National Institutes of Health guidelines.
6     "Project of clinical research" includes a clinical trial.

9     Sec. 10. Inclusion of women and minorities. Except as
10 provided in Section 15 or 30, in conducting or supporting a
11 project of clinical research, a grantee must do all of the
12 following:
13         (1) Ensure that women, including, but not limited to,
14     women over the age of 40 years, are included as subjects in
15     each research project.
16         (2) Ensure that members of minority groups are included
17     as subjects in each research project.
18         (3) Conduct or support outreach programs for the
19     recruitment of women and members of minority groups as
20     subjects in projects of clinical research.
21         (4) Comply with the National Institutes of Health
22     Guidelines on the Inclusion of Women and Minorities in
23     Clinical Research.
