1     AN ACT in relation to townships.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Township Code is amended by changing
5 Sections 285-5 and 285-10 as follows:
 
6     (60 ILCS 1/285-5)
7     Sec. 285-5. Payment of bond fund balance to township.
8     (a) Whenever all the bonds of any township have been fully
9 paid and canceled and there remains in the hands of the county
10 collector of taxes or county treasurer, after the payment, any
11 balance to the credit of the bond fund of the township, the
12 county collector of taxes or county treasurer shall pay to the
13 supervisor of the township the balance of the fund in his
14 hands, taking a receipt of the supervisor for the payment, and
15 the balance may be appropriated and expended in accordance with
16 subsection (a) of Section 285-10.
17     (b) Beginning on the effective date of this amendatory Act
18 of the 93rd General Assembly and through December 31, 2004,
19 whenever all the bonds of any township have been fully paid and
20 canceled and there remains any balance to the credit of the
21 bond fund of the township, including any amounts that were in
22 the bond fund prior to the payment in full and cancellation of
23 the bonds, in the hands of the township supervisor (other than
24 amounts paid to the supervisor under subsection (a)), the
25 balance may be appropriated and expended in accordance with
26 subsection (b) of Section 285-10.

29     Sec. 285-10. Use of moneys.
30     (a) Moneys paid to the township supervisor under subsection
31 (a) of Section 285-5, may be appropriated and expended for

1 defraying the general charges and expenses of the township; for
2 laying out, making, and repairing the roads and bridges of the
3 township and purchasing materials, implements, and machinery
4 for those undertakings; for the maintenance and operation of
5 open spaces; and for the payment of any outstanding orders, all
6 in the manner and proportions the legal voters of the township
7 determine at their annual township meeting or special township
8 meeting duly called for that purpose.
9     (b) Moneys in the hands of the township supervisor under
10 subsection (b) of Section 285-5 may be appropriated and
11 expended only for purposes relating to the purposes for which
12 the bonds were issued.

15 becoming law.
