 1        AN ACT concerning public utilities.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Electric  Supplier  Act  is  amended  by
 5    changing Section 3.4 as follows:

 6        (220 ILCS 30/3.4) (from Ch. 111 2/3, par. 403.4)
 7        Sec.  3.4.  Electric cooperative.  "Electric Cooperative"
 8    means (a) any not-for-profit corporation or other person that
 9    owns, controls, operates or manages, directly or  indirectly,
10    within  this  State, any plant, equipment or property for the
11    production, transmission, sale,  delivery  or  furnishing  of
12    electricity  and  (b)  that either is or has been financed in
13    whole or in part under the federal "Rural Electrification Act
14    of 1936" and the Acts amendatory  thereof  and  supplementary
15    thereto,  or is directly or indirectly caused to be formed by
16    any one or more such  not-for-profit  corporations  or  other
17    persons that is or has been so financed.
