 1        AN ACT in relation to crime stoppers programs.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1. Short title. This Act  may  be  cited  as  the
 5    Crime Stoppers Program Act.

 6        Section  5.  Definition.  In  this  Act,  "crime stoppers
 7    program" means a program that meets  each  of  the  following
 8    requirements:
 9        (a)  The  purpose of the program is to obtain information
10    on persons  wanted  for  crimes,  felony  crimes,  and  other
11    criminal activity.
12        (b)  The  program  has  a law enforcement coordinator who
13    forwards  information  obtained  by  the   program   to   the
14    appropriate law enforcement agency.
15        (c)  The program allows the person submitting information
16    to remain anonymous.
17        (d)  The  program  operates  in  conjunction  with  a law
18    enforcement agency or Office of the State's Attorney.
19        (e)  The program has a civilian board  of  directors,  is
20    incorporated  in  the  State of Illinois, and is certified by
21    the Illinois State Crime Stoppers Association.

22        Section  10.  Certification  of  programs.  The  Illinois
23    State Crime Stoppers Association shall certify Crime Stoppers
24    programs in this State.  On or after the  effective  date  of
25    this  Act,  a  person or agency that is not a certified Crime
26    Stoppers program may not use the name "Crime Stoppers".   The
27    Attorney  General may enforce this Section through injunctive
28    or other appropriate relief.

29        Section 105. The Code of Civil Procedure  is  amended  by

 1    adding Section 8-802.3 as follows:

 2        (735 ILCS 5/8-802.3 new)
 3        Sec. 8-802.3.  Identity of person who submits information
 4    to  a  Crime  Stoppers program; privileged. The identity of a
 5    person who submits information of a criminal act to  a  Crime
 6    Stoppers  program  is  privileged  information and may not be
 7    disclosed  in  any  judicial  or  administrative  proceeding.
 8    Telephone records of a Crime Stoppers program are  privileged
 9    information  and are not subject to disclosure by subpoena or
10    other means. In this Section, "Crime Stoppers program"  means
11    a  program  certified  by  the  Illinois State Crime Stoppers
12    Association under the Crime Stoppers Program Act.
