 1        AN  ACT concerning a statewide advisory referendum on the
 2    State budget crisis.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  1.  Short  title.  This  Act may be cited as the
 6    State Budget Crisis Referendum Act.

 7        Section  5.  Purpose.  Illinois,  as  almost  all   other
 8    states,  is  currently experiencing a State budget crisis. At
 9    the same time, however,  Illinois  enjoys  relatively  modest
10    rates  of  State  income tax: 3% on individuals, estates, and
11    trusts and 4.8% on corporations. The purpose of this  Act  is
12    to  seek  the  advice of the voters as to whether a temporary
13    increase in the State income tax is warranted to  help  solve
14    this crisis.

15        Section   10.  Budget   crisis  advisory  questions.  The
16    following advisory questions shall be submitted to the voters
17    of the entire State at the 2004 general primary election:
18             (1) Should the General  Assembly  and  the  Governor
19        temporarily  increase  the  Illinois  income  tax to help
20        solve the current State budget crisis and  avoid  drastic
21        cuts  in State support for public education and essential
22        health care services?
23             (2)  Should this temporary increase be limited to no
24        more than 2 tax years?
25             (3)  Should this temporary increase  be  limited  to
26        increasing  the  rate of tax for individuals, trusts, and
27        estates by no more than one percentage point and the rate
28        for corporations by no more than one and six-tenths of  a
29        percentage point?
30        All  of  these  3  questions shall be placed on a single,

 1    separate ballot. The votes on each question shall be recorded
 2    as "Yes" or "No".

 3        Section 15.  Certification. The State Board of  Elections
 4    shall  immediately  certify  the questions to be submitted to
 5    the voters of the  entire  State  under  Section  10  to  the
 6    respective  county  clerks  and  to  the  board  of  election
 7    commissioners, if any, in their respective counties.

 8        Section  20.  Conflicts.  If  any  provision  of this Act
 9    conflicts with any other law, this Act controls.

10        Section 90.  Repeal. This Act  is  repealed  on  July  1,
11    2004.

12        Section  99.  Effective  date. This Act takes effect upon
13    becoming law.
