Amends the Illinois Public Aid Code. Provides that the Department of Public
Aid
may not establish any formulary limits on, or restrict by any prior
authorization
requirement, any prescription drug or laboratory or diagnostic test as
prescribed and
determined to be medically necessary for the treatment and prevention of
certain
diseases, including HIV/AIDS, hepatitis C, end stage renal disease, and cancer.
Effective
immediately.

| AN ACT in relation to public aid.
|
| 2 |
| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Illinois Public Aid Code is amended by |
| 5 |
| adding Section 5-5.12b
as
follows:
|
| 6 |
| (305 ILCS 5/5-5.12b new)
|
| 7 |
| Sec. 5-5.12b. Formulary limits; prior authorization.
|
| 8 |
| (a) The Department of Public Aid may not establish any |
| 9 |
| formulary limits on,
or
restrict by any prior authorization |
| 10 |
| requirement, any prescription drug or
laboratory or
diagnostic |
| 11 |
| test as prescribed and determined to be medically necessary for |
| 12 |
| the
treatment
and prevention of the following therapeutic |
| 13 |
| classes:
|
| 14 |
| (1) Any and all medications prescribed for HIV/AIDS |
| 15 |
| for a person
diagnosed with HIV/AIDS illness, including but |
| 16 |
| not limited to protease
inhibitors,
non-nucleoside reverse |
| 17 |
| transcriptase inhibitors, nucleoside reverse
transcriptase
|
| 18 |
| inhibitors, antivirals, and fusion inhibitors.
|
| 19 |
| (2) Any and all medications prescribed for a person |
| 20 |
| diagnosed with
hepatitis C.
|
| 21 |
| (3) Any and all medications prescribed for a person |
| 22 |
| with end stage renal
disease.
|
| 23 |
| (4) Any and all medications prescribed for a person |
| 24 |
| with cancer.
|
| 25 |
| (b) The Department of Public Aid shall make all exemptions |
| 26 |
| and exclusions
from
formulary limitations identified in |
| 27 |
| subsection (a) applicable to all agencies,
departments,
and |
| 28 |
| programs under its jurisdiction.
|
| 29 |
| Section 99. Effective date. This Act takes effect upon |
| 30 |
| becoming law. |
