SYNOPSIS AS INTRODUCED:

20 ILCS 105/4.15 new

Amends the Illinois Act on the Aging. Requires the Department on Aging to develop and maintain an information system concerning the State's aging population and incapacitated and dependent adults and to prepare, publish, and disseminate related educational materials. Provides that the information system must be available for use by State and local agencies and by the public. Requires any public agency or private agency to submit information for the system upon request by the Department. Requires compliance with State and federal confidentiality laws and with federal information sharing standards.

AN ACT concerning information systems.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Act on the Aging is amended by adding Section 4.15 as follows:

(20 ILCS 105/4.15 new)

Sec. 4.15. Information system; aging population and incapacitated and dependent adults.

(a) The Department shall develop and maintain an information system concerning the State's aging population and incapacitated and dependent adults. The Department must prepare, publish, and disseminate educational materials concerning the information system and must continuously develop objective devices and research methodologies for use with the information system. To the fullest extent possible, the Department must use existing sources of information to develop and maintain the information system. The information system must be available for use by the public, by State agencies, by political subdivisions of the State, and by public and private non-profit agencies. All State agencies and all other public or private agencies must comply with requests from the Department for information that is to be included in the information system. In developing and maintaining the information system, the Department must comply with State and federal confidentiality laws. To the extent that it is reasonable to do so, the information system must be compatible with federal information sharing standards.

(b) The information system shall have the following functions:

(1) To conduct research concerning the cause and nature of problems related to the State's aging population and incapacitated and dependent adults.

(2) To collect, maintain, and disseminate data and statistics related to the State's aging population and incapacitated and dependent adults.

(3) To determine, through a detailed survey, the extent of problems related to the State's aging population and incapacitated and dependent adults and the needs and priorities for solving those problems throughout the State.

(4) To maintain an inventory of the types and quantities of both public and private facilities, programs, and services provided for the State's aging population and incapacitated and dependent adults, including: (i) the unduplicated count, location, and characteristics of individuals served by each facility, program, or service and (ii) the source of resources supporting functions related to the State's aging population and incapacitated and dependent adults.

(5) To continuously evaluate: (i) the impact, quality, and value of facilities, programs, and services provided for the State's aging population and incapacitated and dependent adults, including the administrative adequacy and capacity of those facilities, programs, and services, and (ii) programs operated for the State's aging population and incapacitated and dependent adults by or with the assistance of the State or the federal government, including, but not limited to, activities related to education, employment, vocational services, income, health, housing, transportation, community services, social services, rehabilitation services, protective services, public guardianship or conservatorship, supplemental social security, Medicare, Medicaid, property tax refunds, and licensing standards for nursing, intermediate care, and boarding facilities.
