SYNOPSIS AS INTRODUCED:

    Amends the Illinois Architecture Practice Act of 1989. Makes changes in provisions concerning the qualifications for licensure. Provides requirements for a professional architect to acquire emeritus status. Effective July 1, 2004.

1     AN ACT concerning professional regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Architecture Practice Act of 1989
5 is amended by changing Section 13 and by adding Section 17.5 as
6 follows:

9     Sec. 13. Qualifications of applicants. Any person who is of
10 good moral character may take an examination for licensure if
11 he or she is a graduate with a first professional degree in
12 architecture from a program accredited by the National
13 Architectural Accrediting Board and has completed such
14 diversified professional training, including academic
15 training, as is required by rules of the Department. Until
16 January 1, 2010, in In lieu of the requirement of graduation
17 with a first professional degree in architecture from a program
18 accredited by the National Architectural Accrediting Board,
19 the Department may admit an applicant who is a graduate with a
20 pre-professional 4 year baccalaureate degree accepted for
21 direct entry into a first professional master of architecture
22 degree program, and who has completed such additional
23 diversified professional training, including academic
24 training, as is required by rules of the Department. The
25 Department may adopt, as its own rules relating to diversified
26 professional training, those guidelines published from time to
27 time by the National Council of Architectural Registration
28 Boards.
29     Good moral character means such character as will enable a
30 person to discharge the fiduciary duties of an architect to
31 that person's client and to the public in a manner which
32 protects health, safety and welfare. Evidence of inability to

1 discharge such duties may include the commission of an offense
2 justifying discipline under Section 19. In addition, the
3 Department may take into consideration whether the applicant
4 has engaged in conduct or actions that would constitute grounds
5 for discipline under this Act.

9     Sec. 17.5. Emeritus status requirements.
10     (a) An Illinois licensee who has been licensed for at least
11 10 consecutive years, is 65 years of age or older, and is
12 retired from active practice may request emeritus status by
13 filing the request on forms prescribed by the Department. If
14 the requirements of this Section have been met, all fees for
15 the biennial license renewal shall be waived by the Department
16 during the period the architect is in emeritus status. An
17 architect with emeritus status may use the title "emeritus
18 architect" or a derivation thereof.
19     (b) An emeritus architect may be readmitted to the active
20 practice of architecture within 3 years of acquiring emeritus
21 status upon payment of the current renewal fee.
22     (c) An emeritus architect who has held emeritus status in
23 excess of 3 consecutive years may be readmitted to active
24 practice only after filing an application on forms supplied by
25 the Department, payment of the applicable fees, and completion
26 of the current licensing examination or by appearing before the
27 Board to satisfactorily demonstrate his or her qualifications
28 to resume active practice.
29     (d) An emeritus architect seeking readmission to active
30 practice shall be required to meet continuing education
31 requirements as provided by Section 16.5 of this Act.
 
32     Section 99. Effective date. This Act takes effect July 1,
33 2004.
