1     AN ACT concerning animals.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Diseased Animals Act is amended by
5 changing Section 1 and by adding Section 24.1 as follows:
 
6     (510 ILCS 50/1)  (from Ch. 8, par. 168)
7     Sec. 1. For the purposes of this Act:
8     "Department" means the Department of Agriculture of the
9 State of Illinois.
10     "Director" means the Director of the Illinois Department of
11 Agriculture, or his duly appointed representative.
12     "Contagious or infectious disease" means a specific
13 disease designated by the Department as contagious or
14 infectious under rules pertaining to this Act.
15     "Reportable disease" means a specific disease designated
16 by the Department as reportable under rules pertaining to this
17 Act.
18     "Animals" means domestic animals, poultry, and wild
19 animals in captivity.
20     "Exposed to" means for an animal to come in contact with
21 another animal or an environment that is capable of
22 transmitting a contagious, infectious, or reportable disease.
23 An animal will no longer be considered as "exposed to" when it
24 is beyond the standard incubation time for the disease and the
25 animal has been tested negative for the specific disease or
26 there is no evidence that the animal is contagious, except for
27 animals exposed to Johne's disease. Animals originating from a
28 herd where Johne's disease has been diagnosed will be
29 considered no longer "exposed to" with a negative test. The
30 negative test must have been conducted within 30 days prior to
31 the sale or movement.
32     "Swap meet" means an organized event where animals

1 including, but not limited to, dogs, cats, birds, fish,
2 reptiles, or other animals customarily obtained as pets, are
3 sold, traded, or exchange hands.

6     Sec. 24.1. Swap meets. Any organizer of a swap meet held
7 within the State must provide the Department with information
8 regarding the swap meet at least 30 days prior to the date on
9 which the swap meet will be held. For each swap meet that he or
10 she organizes, an organizer must maintain records for at least
11 one year after the date on which the swap meet is held. The
12 records must include information on each kind of animal present
13 at the swap meet and information on any transfer of animals
14 that takes place during the swap meet.
 
15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
