 1        AN ACT in relation to the regulation of professions.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Regulatory  Sunset  Act  is amended by
 5    changing Sections 4.14 and 4.24 as follows:

 6        (5 ILCS 80/4.14) (from Ch. 127, par. 1904.14)
 7        Sec. 4.14.  Acts repealed.
 8        (a)  The following Acts are repealed December 31, 2003:
 9             The Private Detective, Private  Alarm,  and  Private
10        Security Act of 1993.
11             The Illinois Occupational Therapy Practice Act.
12        (b)  The  following  Act  is Acts are repealed January 1,
13    2004:
14             The Illinois Certified Shorthand  Reporters  Act  of
15        1984.
16             The  Veterinary Medicine and Surgery Practice Act of
17        1994.

20        Sec.  4.24.  Acts  repealed  on  January  1,  2014.   The
21    following Acts are repealed on January 1, 2014:
22        The Electrologist Licensing Act.
23        The Illinois Certified Shorthand Reporters Act of 1984.
24        The Illinois Public Accounting Act.

26        Section 10.  The Illinois Certified  Shorthand  Reporters
27    Act of 1984 is amended by changing Section 17 as follows:

 1        (Section scheduled to be repealed on January 1, 2004)
 2        Sec.  17.  Fees;  returned  checks;  expiration  while in
 3    military.
 4        (a)  The fees for the administration and  enforcement  of
 5    this   Act,   including   but   not   limited   to,  original
 6    certification, renewal and restoration, shall be set by rule.
 7        (b)  Beginning July 1, 2003, all of the  fees  and  fines
 8    collected  under this Act shall be deposited into the General
 9    Professions Dedicated Fund.
10        (c)  Any person who delivers a check or other payment  to
11    the  Department  that is returned to the Department unpaid by
12    the financial institution upon which it is drawn shall pay to
13    the Department, in addition to the amount already owed to the
14    Department, a fine of $50. The fines imposed by this  Section
15    are  in  addition to any other discipline provided under this
16    Act  prohibiting  unlicensed  practice  or  practice   on   a
17    nonrenewed  license.  The  Department shall notify the person
18    that  payment  of  fees  and  fines  shall  be  paid  to  the
19    Department by  certified  check  or  money  order  within  30
20    calendar  days  of the notification. If, after the expiration
21    of 30 days from the date of the notification, the person  has
22    failed  to  submit  the  necessary remittance, the Department
23    shall automatically terminate the license or  certificate  or
24    deny  the application, without hearing. If, after termination
25    or denial, the person seeks a license or certificate,  he  or
26    she shall apply to the Department for restoration or issuance
27    of  the license or certificate and pay all fees and fines due
28    to the Department. The Department may establish a fee for the
29    processing of an application for restoration of a license  or
30    certificate   to   pay   all   expenses  of  processing  this
31    application. The Director may waive the fines due under  this
32    Section in individual cases where the Director finds that the
33    fines would be unreasonable or unnecessarily burdensome.
34        However,  any  person  whose license has expired while he

 1    has been engaged (l) in federal or state service active duty,
 2    or (2) in training or education under the supervision of  the
 3    United  States  preliminary  to  induction  into the military
 4    service, may have his license renewed, reinstated or restored
 5    without paying any lapsed renewal and  restoration  fees,  if
 6    within 2 years after termination of such service, training or
 7    education  other than by dishonorable discharge, he furnishes
 8    the Department with satisfactory proof that he  has  been  so
 9    engaged  and that his service, training or education has been
10    so terminated.

12        Section 99.  Effective date.  This Act takes effect  upon
13    becoming law.
