 1        AN ACT concerning unemployment insurance.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Unemployment Insurance Act is amended by
 5    adding Section 500.1 as follows:

 6        (820 ILCS 405/500.1 new)
 7        Sec. 500.1.  Birth and Adoption Unemployment Insurance.
 8        (a)  A parent who is on a leave of absence  from  his  or
 9    her  employer  or  who  left employment to be with his or her
10    child during the child's first year of life,  or  during  the
11    first year following placement of a child age 18 or less with
12    the  individual  for adoption, may not be denied compensation
13    on  the  grounds  that  he  or  she  has   voluntarily   left
14    employment,  that  he or she has not been available for work,
15    that he or she has not been able to work, or that he  or  she
16    has failed to actively seek work.
17        (b)  As used in this Section:
18             (1)  "Parent"  means a mother or father (biological,
19        legal, or who has custody of a child pending her  or  his
20        adoption of that child); and
21             (2)  "Placement"  means  the  time  a parent becomes
22        responsible for a child pending  adoption  in  accordance
23        with the Adoption Act.
24        (c)  Sections  610  and  611 apply to payments under this
25    Section. In addition, the following payments  shall  cause  a
26    reduction in the compensation amount:
27             (1)  Any  payment from the employer resulting from a
28        birth or adoption described in subsection (a); and
29             (2)  Any payment resulting from a birth or  adoption
30        described  in  subsection (a) from a disability insurance
31        plan contributed to by an employer, in proportion to  the

 1        employer's contribution to the plan.
 2        (d)  Compensation  is payable to an individual under this
 3    Section for a maximum of 12 weeks with respect to  any  birth
 4    or placement for adoption.
 5        (e)  Each  employer  shall  post at each site operated by
 6    the employer, in  a  conspicuous  place,  accessible  to  all
 7    employees,  information relating to the availability of Birth
 8    and Adoption Unemployment Insurance.
 9        (f)  Any compensation paid under this Section may not  be
10    charged to the account of the individual employer.
11        (g)  Two  years  following  the  effective  date  of this
12    amendatory Act of the 93rd  General  Assembly,  the  Director
13    shall issue a report to the Governor and the General Assembly
14    evaluating   the   effectiveness   of   Birth   and  Adoption
15    Unemployment Insurance.
16        (h)  This  Section  shall  be  applied  consistent   with
17    regulations issued by the U.S. Department of Labor.

18        Section  99.  Effective date.  This Act takes effect upon
19    becoming law.
